Consiliul Local al Ora\u015fului Jibou:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp; Av\u00e2nd \u00een vedere:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp; -raportul nr.2535 din 05.03.2019 al Biroului\nUrbanism, amenajarea teritoriului si administrarea domeniului public si privat;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp; -expunerea de motive&nbsp; nr. 2536 din 05.03.2019 a domnului Primar;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp; -avizele&nbsp;\nfavorabile&nbsp;&nbsp; ale&nbsp; comisiilor&nbsp;\nde specialitate&nbsp; ale Consiliului\nLocal<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen conformitate\ncu:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Legea nr. 213\/1998 privind bunurile proprietate public\u0103 ;<\/li><li>Legea nr.\n650\/2002 &#8211; pentru aprobarea Ordonantei Guvernului nr. 99\/2000 privind\ncomercializarea produselor si serviciilor de piata;<\/li><li>Hotararea\nGuvernului Romaniei nr. 348\/2004 \u2013 privind exercitarea comertului cu produse si\nservicii de piata \u00een unele zone publice;&nbsp;&nbsp;\n<\/li><li>Hotararea\nGuvernului Romaniei nr. 955\/2004 \u2013&nbsp;\npentru aprobarea reglementarilor cadru de aplicare a Ordonantei\nGuvernului nr. 71\/2002 privind organizarea si functionarea serviciilor publice\nde administrare a domeniului public si privat de interes local; <\/li><li>Legea nr.\n50\/1991 republicata si actualizata \u2013 privind autorizarea executarii lucrarilor\nde constructii; cu toate modificarile si completarile ulterioare; <\/li><li>Legea nr.\n12\/1990 republicata &#8211; privind protejarea populatiei impotriva unor activitati\ncomerciale ilicite; cu toate modificarile ulterioare republicat\u0103;<\/li><li>Ordonanta nr.2\/2001\n&#8211; privind regimul juridic al contraventiilor; cu toate modificarile si\ncompletarile ulterioare; <\/li><li>Codul Civil nr.\n287\/2009 republicat\u0103, Titlul III, &#8211; Despre Contracte si Conventii;<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp; \u00cen temeiul art 45 alin (1) art.&nbsp; art.36,(2) lit.c)&nbsp; din Legea nr. 215\/2001 privind administra\u0163ia\npublic\u0103 local\u0103, republicat\u0103, cu modific\u0103rile \u0219i complet\u0103rile ulterioare;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>HOT\u0102R\u0102\u0218TE:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\nArt.1 <\/strong>Se\naprob\u0103 Regulamentul local privind condi\u021biile de dasf\u0103\u0219urare a unor activit\u0103\u021bi\nde comer\u021b stradal pe terenul apar\u021bin\u00e2nd domeniului public\/privat al ora\u0219ului\nJibou, conform anexei parte integrant\u0103 din prezenta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ANEXA LA HCL nr. 26 \/2019<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">REGULAMENT LOCAL\nPRIVIND CONDITIILE DE DESFASURARE A UNOR ACTIVITATI DE COMERT STRADAL PE\nTERENUL APARTINAND DOMENIULUI PUBLIC\/PRIVAT AL ORASULUI JIBOU<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CAPITOLUL I <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>DISPOZITII GENERALE <\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Scopul\nRegulamentului<\/strong><\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 1. Prezentul regulament stabileste reg<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">uli generale care trebuie sa reglmenteze\n&nbsp;desfasurarea de activitatilor de comert\nstradal de lunga durata, sezoniere si ocazionale in zone publice pe terenul\napartinand domeniului public\/privat al U.A.T. Oras Jibou. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regulamentu se aplica fara exceptie atat\npe domeniul public\/privat al UAT Oras Jibou cat si pe proprietatea persoanelor\nfizice sau juridice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.2 Domeniul de\nreglementare <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 2. Prevederile prezentului\nregulament se aplica: organizatiilor fara scop lucrativ, agentilor economici \u2013\npersoane fizice sau juridice autorizate care desfasoara activitati sociale,\nsportive, comerciale, sau presteaza servicii catre populatie: producatorilor\ndirecti, comerciantilor, organizatiilor si fundatiilor, institutiilor publice,\netc, in zonele publice din U.A.T. Orasui Jibou. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.3. In zonele publice din U.A.T. Oras\nJibou sunt interzise cu desavarsire activitatile care incita la violenta, la\nura, sau care pericliteaza siguranta populatiei, activitatile care tulbura\nlinistea si ordinea publica, activitatile de cersetorie, strangere de fonduri\nsi alte activitati similare. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.3 Cadrul legal general\nde reglementare a domeniului: <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 4 Activitatile in zonele publice\nsunt reglementate prin: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Legea\nnr. 215\/2001 republicata \u2013 privind administratia publica locala &#8211; art.36,(2)\nlit.c) si art.36; <\/li><li>Legea\nnr. 650\/2002 &#8211; pentru aprobarea Ordonantei Guvernului nr. 99\/2000 privind\ncomercializarea produselor si serviciilor de piata;<\/li><li>Hotararea\nGuvernului Romaniei nr. 348\/2004 \u2013 privind exercitarea comertului cu produse si\nservicii de piata.&nbsp;&nbsp; <\/li><li>Hotararea\nGuvernului Romaniei nr. 955\/2004 \u2013&nbsp;\npentru aprobarea reglementarilor cadru de aplicare a Ordonantei\nGuvernului nr. 71\/2002 privind organizarea si functionarea serviciilor publice\nde administrare a domeniului public si privat de interes local; <\/li><li>Legea\nnr. 50\/1991 republicata si actualizata \u2013 privind autorizarea executarii\nlucrarilor de constructii; cu toate modificarile si completarile ulterioare <\/li><li>Legea\n60\/1991 republicata &#8211; privind organizarea si desfasurarea adunarilor\npublice;&nbsp; <\/li><li>Legea\nnr. 12\/1990 republicata &#8211; privind protejarea populatiei impotriva unor\nactivitati comerciale ilicite; cu toate modificarile ulterioare <\/li><li>Ordonanta\nnr.2\/2001 &#8211; privind regimul juridic al contraventiilor; cu toate modificarile\nsi completarile ulterioare <\/li><li>Legea\nnr.126\/1995 &#8211; privind regimul materiilor explozive &#8211; republicata si\nactualizata; <\/li><li>Codul\nCivil, Titlul III, &#8211; Despre Contracte si Conventii.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CAPITOLUL II <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>DEFINITII SI CLASIFICARI <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Art. 4. Definirea unor termeni\nutilizati pe parcursul regulamentului <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>agent\neconomic<\/strong> \u2013 persoana fizica sau juridica autorizata, care in cadrul\nactivitatii sale profesionale, fabrica, importa, depoziteaza, transporta sau\ncomercializeaza produse, ori parti din acestea, sau presteaza servicii,\ndefinite in baza legii 15\/1990 privind reorganizarea unitatilor economice de\nstat ca regii autonome si societati comerciale. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>consumator<\/strong>\n&#8211; orice persoana fizica, sau grup de persoane fizice constituite in asociatii,\ncare cumpara, dobandesc, utilizeaza, ori consuma produse, sau servicii in afara\nactivitatii profesionale;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>comerciant<\/strong>\n&#8211; persoana fizica sau juridica autorizata sa desfasoare activitati de\ncomercializare a produselor si serviciilor de piata;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>comert\nstradal<\/strong> &#8211; comert, cu caracter permanent, sezonier, sau ocazional,\ndesfasurat pe domeniul public, in afara spatiului magazinelor, de regula in\nzone cu intensa circulatie pietonala, pe strazi, trotuare, pasaje publice, sau\norice zona destinata folosintei publice. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>comert\nambulant<\/strong> &#8211; activitatea de comercializare cu amanuntul realizata prin\nvanzarea in mai multe locatii, pe unitati (standuri) mobile, rulote, sau in\nvehicule special amenajate, care la incheierea programului elibereaza\namplasamentul <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>comert\nocazional<\/strong> \u2013 activitatea de comert stradal desfasurata cu ocazia anumitor\nevenimente, pe o&nbsp; perioada limitata de\ntimp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>comert\nsezonier<\/strong> &#8211; activitatea de comert stradal desfasurata in perioade de timp\ndeterminate, de regula in sezoanele turistice; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>punct\nde desfasurare a activitatii<\/strong> \u2013 spatiu public delimitat in cadrul\namplasamentului, avizat si pus la dispozitia partenerilor pentru desfasurarea\nactivitatii <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>comert\nstradal in puncte fixe<\/strong> &#8211; activitatea de comercializare in orice structura\nde vanzare cu amanuntul realizata pe amplasamentele stabilite&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>structura\nde vanzare\/promovare<\/strong> &#8211; spatiul de desfasurare a unuia, sau mai multor\nexercitii comerciale;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>chiosc\nstradal<\/strong> \u2013 constructie usoara, de mici dimensiuni, temporara, avand una din\nlaturi (sau mai multe) deschise, amplasata pe strazi si in zone publice, din\ncare se vand: flori, ziare, reviste, tigari, sucuri, alte produse;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>terasa\nde alimentatie publica<\/strong> \u2013 spatiu amenajat in fata unitatii proprii de\nalimentatie publica, in vederea servirii consumatorilor; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>toneta<\/strong>\n\u2013 structura de vanzare deschisa, taraba, la care se vand, pe strada, articole\nmarunte, dulciuri, racoritoare, etc;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; <strong>autospeciale,\nautoutilitare<\/strong> \u2013 structura de vanzare specializata montata pe un mijloc de\ntransport (autospeciala, remorca, tricicleta, etc.) utilizata pentru vanzarea\nsau expunerea anumitor produs <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CAPITOLUL III <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>NOMENCLATOR DE ACTIVITATI<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 5. <strong>Nomenclator de activitati ce pot fi desfasurate pe domeniul public si\nprivat al UAT Oras Jibou precum si pe proprietatea personala a persoanelor\nfizice si juridice<\/strong>:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. activitati comerciale: <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a).comercializare produse alimentatie\npublica, tip fast food , produse alimentare si&nbsp;&nbsp;\nnealimentare&nbsp; ambalate ;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b).comercializare produse de panificatie\nsi patiserie ;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c).comercializare produse si preparate\ndin carne&nbsp; ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">d).comercializare inghetata in vitrina\nfrigorifica ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">e).comercializare pop corn,\naparat\/dozator inghetata, lapte;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">f).comercializare flori si aranjamente\nflorale&nbsp; ;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">g).comercializare presa, carti , ziare\nsi&nbsp; alte&nbsp;\npublicatii ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">h).comercializare martisoare , bete Sf.\nNicolae, alte produse care se preteaza acestui tip de comert ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">i). comercializare fructe si legume .<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. activitati comerciale\nocazionale <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>a).\nIn perioada&nbsp; Nicolae, etc ; <\/li><li>f).\nTargul de Craciun si de Pasti \u2013 comercializare felicitari, cadouri, jucarii,\npodoabe de pom, obiecte de cult, etc .<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. activitati cu caracter\nsocial, sau de interes public <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>evenimente\nsocial-sportive, politice sau de interes public <\/li><li>distribuirea\nde pliante in campaniile de informare,&nbsp; <\/li><li>consultatiile\nmedicale gratuite, in cadrul unor campanii <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. activitati cu caracter\ncultural <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>festivaluri\n<\/li><li>concerte\n<\/li><li>targuri\n<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. activitati de\nagrement&nbsp;&nbsp; <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>parcuri\nde distractii, masinute, tobogane gomflabile,&nbsp;\n<\/li><li>organizarea\njocurilor de artificii; <\/li><li>circuri,&nbsp; <\/li><li>menajerii,\ntarguri de pasari, de animale de companie, <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 6. <strong>Comertul stradal poate fi clasificat astfel:<\/strong> <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.1\nfunctie de durata de desfasurare a activitatii: <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>comert\nocazional; <\/li><li>comert\nsezonier; <\/li><li>comert\nde lunga durata; <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.2\n. functie de locul amplasarii acestora<\/strong>:&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a). in zone pietonale, in fata\nunitatilor de profil, se pot comercializa: flori , ziare si reviste,\ncarti,&nbsp; produse de patiserie, cofetarie,\nvitrina frigorifica pentru inghetata si aparat pentru inghetata;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b). in parcuri (doar in cazul in care au\nfost prevazute astfel de amplasamente in proiectul parcului); <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c). alte spatii publice . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.3. <strong>functie de modul de amplasare<\/strong>:&nbsp;\n<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>pe\nbaza acordului de amplasare; <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">6.4. <strong>functie de structura de vanzare utilizata<\/strong>: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>chioscuri;\n<\/li><li>tonete;\n<\/li><li>triciclete,\nautospeciale, autoutilitare, sau alte tipuri de unitati mobile destinate\ndesfasurarii de activitati comerciale; <\/li><li>vanzari\nfara utilizarea de mobilier urban;&nbsp; <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CAPITOLUL IV <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>PROCEDURA DE AUTORIZARE <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.7 Amplasamentele pentru desfasurarea\nde comert stradal vor fi propuse de catre persoana responsabila din cadrul biroului\nUrbanism si Amenajarea teritoriului al UAT Oras Jibou . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.8 Activitatea de comert stradal in\nOrasul Jibou se desfasoara de catre agentii economici in baza acordului de amplsament\nambulant emis la cererea acestora, cu respectarea prevederilor din prezentul\nregulament .&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Daca agentul economic renunta la\namplasarea pe domeniul public a mobilierului urban&nbsp; sau inceteaza activitatea inainte de termenul\naprobat prin acord\/aviz trebuie sa inregistreze la sediul Primariei Jibou&nbsp; \u2013 Biroul urbanism si Amenajarea\nTeritoriului&nbsp; o cerere in care sa\nprecizeze numarul acordului \/avizului si data incetarii activitatii. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cererea de anulare a acordului\/avizului\nnu poate fi facuta retroactiv. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.9&nbsp;\nPot fi atribuite fara licitatie publica amplasamentele situate in fata\npunctului de lucru fix, cu acelasi profil, la cererea detinatorilor spatiilor\ncomerciale respective, numai pentru cele prevazute la punctul 6.2 lit. a .&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.10 Societatile care isi desfasoara\nactivitatea intr-un punct de lucru fix si care solicita atribuirea unui spatiu\nin fata punctului de lucru pentru comercializare produse mai sus\nmentionate&nbsp; trebuie sa detina acord de amplasament\neliberat de catre Primaria UAT Oras Jibou. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.11&nbsp;\nDesfasurarea activitatii de comert stradal in zone publice nu se poate\nrealiza fara acordul\/avizul emis de Primaria UAT Oras Jibou sau cu incalcarea\nmentiunilor din acesta. In cazul nerespectarii mentiunilor din acord\/aviz,\nconstatate&nbsp; de cel mult doua ori, acesta\nva fi retras definitiv. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.12 Agentilor economici,\nintreprinderilor individuale si familiale precum si persoanelor fizice\nautorizate care au debite&nbsp; sau amenzi\ncontraventionale neachitate, nu li se vor mai elibera acorduri\/avize de\nfunctionare pana la achitarea tuturor obligatiilor financiare fata de bugetul\nlocal . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.13&nbsp;\nAmplasamentele pentru desfasurarea exercitiilor comerciale stradale, cu\nexceptia celor de la art. 9, vor fi atribuite in urma organizarii unor\nlicitatii publice . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amplasamentele vor fi aprobate prin\nHotarare a Consiliului Local. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Conditiile care trebuiesc indeplinite\npentru participarea la licitatie vor fi stabilite prin caietul de sarcini,\naprobat prin Hotarare a Consiliului Local. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.14&nbsp;\nCu ocazia targurilor&nbsp; si a\ndiverselor evenimente culturale si sportive se pot amplasa diferite tipuri de\nmobilier stradal, rulote sau vehicule comerciale, la cererea organizatorilor cu\navizul Politiei Locale si a Biroului Urbanism si Amenajarea Teritoriului . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.15&nbsp;\nIn cazul prelungirii contractelor de inchiriere a terenului pentru\ndesfasurarea activitatilor de comert stradal in derulare (comert cu flori,\nchioscuri, etc.) se vor aplica&nbsp;\nprevederile prezentului Regulament si regulile de drept comun . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CAPITOLUL V. <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>OBLIGATIILE COMERCIANTILOR\nCARE DESFASOARA ACTIVITATI DE COMERT STRADAL &nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 16&nbsp;\nComerciantii care desfasora activitati de comert stradal au urmatoarele\nobligatii : <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. Sa desfasoare activitati de comert\nstradal in mod civilizat, cu respectarea normelor legale privind igiena si\nsanatatea publica, protectia consumatorilor, provenienta si calitatea\nmarfurilor, protectia muncii ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. Sa utilizeze mijloace de cantarire\nautorizate, sa detina buletin de verificare metrologica a cantarelor ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. Sa afiseze datele de identificare\n(denumire si sediul social) si acordul\/avizul de functionare stradal ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. Sa asigure expunerea estetica a\nproduselor si afisarea in mod vizibil a preturilor ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5. Sa utilizeze mobilierul avizat de\ncatre persoana responsabila din cadrul Primariei UAT Oras Jibou cu respectarea\nsuprafetei autorizate si a mentiunilor din acord; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.&nbsp;\nSa respecte ordinea, linistea publica si curatenia in perimetrul\namplasamentului si sa nu creeze disconfort riveranilor ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7. Sa nu aduca prejudicii zonelor verzi\nsi mediului inconjurator ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">8. Sa asigure si sa impuna personalului\nde deservire : <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) echipament de protectie sanitara si\necuson cu date de identificare ;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) personalul de deservire sa detina\ndocumente de identificare si carnetul de sanatate . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">9.Sa respecte orarul de functionare\naprobat de Primaria UAT Oras jibou la locul de desfasurare a activitatii de\ncomert stradal; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">10.Este obligatorie amplasarea\nrecipientilor speciali pentru deseuri la locul desfasurarii activitatii\ncomerciale. Este interzisa depozitarea marfurilor si a&nbsp; deseurilor in zona publica ocupata sau in\nperimetrul ei; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.Pentru comerciantii care desfasoara\nactivitatea comerciala in gherete, tonete, chioscuri, standuri, etc., este\nobligatoriu sa pastreze aspectul ingrijit al acestora, intervenind cu\nreparatiile, reconditionarile, lucrarile care se impun ori de cate ori este\ncazul&nbsp; ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">12.Orice activitate comerciala care se\ndesfasoara pe artere sau in zone pietonale se autorizeaza cu conditia de a nu\nperturba circulatia pietonilor ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">13.Comerciantii care desfasoara\nactivitati comerciale in zone publice sunt obligati sa intrerupa , sa suspende\nsau sa restranga activitatea in cazul efectuarii unor lucrari de utilitate\npublica sau in cazul in care functionarea pe acel amplasament este de natura a\ncauza prejudicii proprietarilor imobilelor invecinate . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 17. Obligatiile organizatorilor de\nevenimente sociale, sportive, culturale sau de agrement pe domeniul public\/privat\nal orasului Jibou:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;a) sa respecte amplasamentul, suprafata\natribuita, perioada de desfasurare si tipul activitatii autorizate ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) prin activitatea desfasurata sunt\nobligati sa nu tulbure linistea si ordinea publica, sa nu impiedice circulatia\npietonala si rutiera, sa nu deterioreze mobilierul urban, constructiile, sau\nzonele verzi din vecinatatea amplasamentului; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">c) Sa detina toate avizele si acordurile\nprevazute de lege pentru desfasurarea actiunii autorizate pe domeniul public. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">d) Prin actiunile desfasurate sa nu\nincite la violenta, sau sa creeze stari conflictuale de orice natura (politica,\netnica, religioasa, etc.); <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;<strong>CAPITOLUL VI&nbsp;&nbsp;&nbsp; <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;REGULI DE AMPLASARE A STRUCTURILOR DE VANZARE <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;VI. 1 . CHIOSCURI , TONETE&nbsp; <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.18. De la data adoptarii prezentului\nRegulament toate chioscurile si tonetele existente pe domeniul public si care\nnu detin contracte de inchiriere&nbsp; pentru\nteren sau acestea&nbsp; sunt expirate&nbsp; vor fi ridicate de pe domeniul public de\ncatre proprietarii acestora in termen de 60 de zile de la intrarea in vigoare a\nprezentului Regulament , in caz contrar, vor fi demolate pe cale administrativa\npe cheltuiala proprietarilor acestora .&nbsp;&nbsp;&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.19. Noile locatii stabilite de\nadministratia publica locala pe domeniul public pentru amplasarea chioscurilor\nsi tonetelor destinate comercializarii produselor alimentare sau nealimentare,\npentru prestarea serviciilor precum si chioscuri , tonete pentru comercializare\nziare si reviste, carti se inchirieaza prin licitatie publica, in conditiile\nlegii, prin incheierea unui contract de inchiriere .&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pretul care se liciteaza&nbsp; pentru ocuparea domeniului public porneste de\nla valoarea stabilita de Serviciul Contabilitate si aprobata prin Hotarare de\nConsiliu Local.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.20. Amplasamentele sunt propuse de\ncatre Biroul Urbanism si Amenajarea Teritoriului din cadrul Primariei UAT oras\nsi vor fi adoptate prin Hotarare a Consiliului Local. Ori de cate ori se\nidentifica noi locatii se va completa anexa prezentului Regulament prin\nHotarare de Consiliu Local. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.21. Conditiile pe care trebuie sa le\nindeplineasca structurile de vanzare sunt urmatoarele: <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; sa asigure conditiile corespunzatoare\npentru expunerea, pastrarea si protejarea marfurilor ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; dimensionarea se va face in functie de\nzona si destinatie fara insa ca aceasta sa depaseasca suprafata maxima admisa\nde 15 mp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; sa asigure spatiu suficient pentru\ndeservirea clientilor , fara a depasi suprafata acestuia si fara a depozita\nproduse pe trotuar. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.22.Durata inchirierii este de 2 ani,\nputand fi prelungita potrivit regulilor de drept comun. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art.23.Pentru amplasarea chioscurilor si\ntonetelor ( cu exceptia chioscurilor si tonetelor destinate difuz\u0103rii \u015fi\ncomercializ\u0103rii presei, c\u0103r\u0163ilor, florilor care se incadreaza in prevederile\nart. 25) la locul adjudecat prin licitatie publica , comerciantul va solicita\nautorizatie de construire, in conditiile legii. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In situatia in care in locatia pe care a\nfost amplasat chioscul sau toneta se efectueaza lucrari de utilitate publica\ncare impun incetarea contractelor de inchiriere&nbsp;\ninainte de ajungere la termen, acestea se vor ridica de catre\nproprietarii mobilierului de pe domeniul public la somatia prealabila a\nPrimariei UAT Oras Jibou, urmand a fi amplasate temporar pe un alt amplasament\nstabilit de catre Biroul Urbanism si Amenajarea teritoriului din cadrul\nPrimariei in termen de 30 zile de la intrarea in vigoare a prezentului\nRegulament si care vor fi adoptate prin Hotarare a Consiliului Local . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; In cazul in care situatia\npermite, chioscurile sau tonetele vor reveni pe vechiul amplasament . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Somatia se expedieaza cu cel\nputin 15 de zile&nbsp; inainte de data limita\na ridicarii chioscurilor sau tonetelor.&nbsp;&nbsp;&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 24.Chioscurile si tonetele pot fi\nracordate la utilitati urbane pe cheltuiala comerciantului si cu riscul\ndeterminat de o dezafectare prematura a acestora . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 25.Pentru amplasarea pe sol a\nobiectelor de mobilier urban pe domeniul public destinate difuz\u0103rii \u015fi\ncomercializ\u0103rii presei, c\u0103r\u0163ilor, florilor \u015fi altele asemenea &#8211; tonete, pupitre\nacoperite sau \u00eenchise (chio\u015fcuri) cu suprafa\u0163a construit\u0103 de maximum 5,00\nm\u00b2&nbsp; nu este necesar\u0103 emiterea\nautoriza\u0163iei de construire in conformitate cu legislatia in vigoare .&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 26.Conditiile pentru participarea\nla licitatie in vederea ocuparii terenului prin amplasarea de&nbsp; chioscuri si tonete pe domeniul public vor fi\nprevazute in Caietul de sarcini aprobat prin Hotarare a Consiliului Local . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. &nbsp;27. 1).Acordul amplasament pentru chioscuri si\ntonete de comercializare presa, flori se emite in baza cererii tip a\nsolicitantului inregistrata la sediul Primariei UAT Oras Jibou <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;2).Cererea va fi insotita de&nbsp; documentele prevazute in Anexa la&nbsp; prezentul Regulament.&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI.2. RULOTE&nbsp; MOBILE <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 28.&nbsp;\nLocatiile unde vor fi amplasate rulotele comerciale pe domeniul\npublic&nbsp; vor fi stabilite de catre <a>Biroul\nUrbanism si Amenajarea Teritoriului <\/a>din cadrul Primariei UAT\nOras Jibou si vor fi&nbsp; ocupate prin licitatie\npublica de catre comerciantii interesati in conditiile respectarii&nbsp; legii si a&nbsp;\nprezentului Regulament&nbsp; prin\nincheierea unui contract de inchiriere .&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pretul care se liciteaza&nbsp; pentru ocuparea domeniului public porneste de\nla valoarea stabilita de Serviciul Contabilitate si aprobata prin Hotarare de\nConsiliu Local.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 29. Amplasamentele sunt propuse de\ncatre Biroul Urbanism si Amenajarea Teritoriului din cadrul Primariei UAT oras\nsi vor fi adoptate prin Hotarare a Consiliului Local. Ori de cate ori se\nidentifica noi locatii se va completa anexa prezentului Regulament prin\nHotarare de Consiliu Local. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 30. Durata inchirierii este de 2\nani, putand fi prelungita potrivit regulilor de drept comun. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 31.&nbsp;\nIn situatia in care in locatia pe care a fost amplasata rulota se\nefectueaza lucrari de utilitate publica care impun incetarea contractelor de\ninchiriere&nbsp; inainte de ajungere la\ntermen,&nbsp; acestea se vor muta de catre\nproprietari de pe domeniul public la somatia prealabila a Primariei UAT Oras\njibou, urmand a fi amplasate temporar pe un alt amplasament&nbsp; stabilit de catre Persoana desemnata din\ncadrul Primariei <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">UAT Oras jibou in termen de 30 zile de\nla intrarea in vigoare a prezentului Regulament si care vor fi adoptate prin\nHotarare a Consiliului Local . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In cazul in care situatia permite, dupa\nterminarea lucrarilor,&nbsp; rulota va reveni\npe vechiul amplasament . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Somatia se expedieaza cu cel putin 15 de\nzile&nbsp; inainte de data limita a ridicarii\nrulotelor .&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 32. Pentru amplasarea rulotelor\natat pe domeniul public&nbsp; cat si pe\nproprietatea personala a&nbsp; persoanelor\nfizice sau juridice&nbsp; este obligatoriu : <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a). utilizarea numai a rulotelor de tip\ncomercial, omologate si inmatriculate in stare de functionare;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b). sa detina autonomie privind\nutilitatile si posibilitatile de racordare . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 33. 1).Acordul de amplasare pentru\nrulote pe domeniul public cat si pe proprietatea persoanelor fizice sau\njuridice se emite in baza cererii tip a solicitantului inregistrata la sediul\nPrimariei UAT Oras Jibou . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;2). Cererea va fi\ninsotita de&nbsp; documentele prevazute in\nAnexa la prezentul Regulament.&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI.3.&nbsp; MOBILIER URBAN AMPLASAT IN FATA UNITATII DE\nPROFIL<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(\nflori, ziare si reviste, carti,&nbsp; produse\nde patiserie, cofetarie, vitrina frigorifica pentru inghetata si aparat pentru\ninghetata)&nbsp; <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 34.&nbsp;\n(1) In fata punctului de lucru al societatii cu acelasi profil se poate\namplasa mobilier urban pentru vanzare inghetata, flori, ziare si reviste,\ncarti, produse de patiserie&nbsp; fara licitatie\npublica, dar, cu o suprafata nu mai mare de 6 mp , cu conditia sa nu afecteze\ncirculatia pietonala si activitatea societatilor&nbsp; invecinate , iar produsele expuse spre\nvanzare sa corespunda profilului de activitate desfasurat la punctul de lucru respectiv.&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (2) In fata chioscurilor si\ntonetelor este interzisa amplasarea mobilierului urban (tarabe, pupitre, etc),\nstanduri de expunere a marfii sau frigidere cu bauturi, sucuri, etc. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (3) Pretul&nbsp; pentru ocuparea domeniului public&nbsp; este stabilit in conformitate cu valoarea\nstabilita prin Hotarare a Consiliului Local&nbsp;\nprivind impozitele si taxele locale .&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 35. Forma, dimensiunile si aspectul\nmobilierului urban&nbsp; se avizeaza de&nbsp; catre persoana responsabila cu urbanismul si\namenajarea teritoriului.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 36. Pentru amplasarea mobilierului\nurban este obligatoriu : <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">a) sa asigure conditii corespunzatoare\npentru expunerea , protejarea si pastrarea marfurilor ; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">b) sa se incadreze in specificul\narhitectural al zonei . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 37.1). Acordul amplasare se emite\nin baza cererii tip a solicitantului inregistrata la sediul Primariei UAT Oras\njibou . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2). Cererea va fi insotita de&nbsp; documentele prevazute in Anexa la prezentul\nRegulament.&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI.4&nbsp; COMERCIALIZAREA&nbsp; CARTILOR, FLORILOR, APARAT\/DOZATOR&nbsp; INGHETATA, LAPTE&nbsp;&nbsp; <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 38. Cartile, florile,\naparat\/dozator, inghetata, lapte&nbsp; se pot\ncomercializa in zone publice in amplasamentele stabilite de catre Biroul\nUrbanism si Amenajarea Teritoriului din cadrul Primariei UAT Oras jibou in\ntermen de 30 zile de la intrarea in vigoare a prezentului Regulament si vor fi\nadoptate prin Hotarare a Consiliului Local si ocupate prin licitatie publica de\ncomerciantii interesati cu respectarea legislatiei in vigoare prin incheierea\nunui contract de inchiriere.&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 39. Forma, dimensiunile si aspectul\nstandurilor de expunere se avizeza de persoana responsabila in domeniul\nurbanismului si amenajarea teritoriului .&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 40. Pretul care se liciteaza&nbsp; pentru ocuparea domeniului public porneste de\nla valoarea stabilita de Serviciul Contabilitate si aprobata prin Hotarare de\nConsiliu Local.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 41.&nbsp;\nDurata inchirierii este de 2 ani, putand fi prelungita potrivit\nregulilor de drept comun. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 42. 1). Acordul de amplasament se\nemite in baza cererii tip a solicitantului inregistrata la sediul Primariei UAT\nOras jibou&nbsp; . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 2).\nCererea va fi insotita de&nbsp; documentele\nprevazute in Anexa la prezentul Regulament.&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI.5 TERASE <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 43 Terasele\nprovizorii \u2013&nbsp; pot fi amenajate in fata\npunctului de lucru, cu profil de alimentatie publica de catre detinatorul\nacestuia, pe baza acordului de amplasare respectand urmatoarele reguli de la\n43.1: <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">-Atribuirea\namplasamentelor pentru amenajarea teraselor sezoniere, in fata punctului de\nlucru se face fara licitatie publica, terasele se vor amplasa de-a lungul\nfatadelor in fata punctului de lucru. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Mobilierul urban va\nfi realizat de preferinta din lemn sau metal in concordanta cu arhitectura\ncladirilor. Este interzisa ancorarea mobilierului urban (mese, scaune, banci,\njardiniere, etc) in pavajul pietonalului.&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp; &#8211; Terasele pot fi acoperite cu umbrele\nconfectionate din materiale impermeabile si rezistente la intemperii, culorile\nvor fi alese in nuante pastel din aceiasi gama cromatica cu fatadele cladirilor\nsituate de aceiasi parte a strazii. Invelitoarea umbrelelor, nu va fi\ninscriptionata. Prinderea umbrelelor se va face in sistem independent, fara a\nafecta pavajul. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Iluminatul terasei va\nfi asigurat prin surse proprii &#8211; lumanari, fara improvizatii de cabluri aeriene\nsau prin pozarea in zona pavajului <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">43.1&nbsp; reguli de amplasare a teraselor: <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Terasele provizorii\n\u2013&nbsp; pot fi amenajate in fata punctului de\nlucru, cu profil de alimentatie publica de catre detinatorul acestuia,\nrespectand urmatoarele reguli:. <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>terasele se vor\namplasa, pastrand un spatiu de circulatie pe langa aceasta. In cazul amplasarii\nacesteia pe&nbsp; trotuar spatiul de trecere\npentru pietoni va fi de minimum 1,5 m, spre carosabil. <\/li><li>in situatiile\nin care mai multi comercianti au activitatea in acelasi imobil cu sau fara\nfront la artera principala si solicita fiecare amenajarea unei terase,\ndimensionarea acestora se va face astfel incat sa poata fi amplasate. <\/li><li>se interzice\namplasarea teraselor pe carosabil <\/li><li>pe suprafata\namenajata ca terasa, operatorul economic va utiliza mobilierul urban (mese,\nscaune, umbrele) aprobat. Materialul si cromatica se va armoniza cu culorile si\narhitectura specifice zonei.&nbsp; <\/li><li>in scopul\namenajarii teraselor, se interzice acoperirea pavajului cu orice fel de\nmaterial textil, sintetic, sau platforme provizorii ori postamente, indiferent\nde materialele din care sunt realizate. <\/li><li>terasele pot fi\nacoperite cu umbrele realizate din materiale impermeabile, rezistente la\nintemperii, vor avea aceiasi forma, culoare si dimensiuni si nu vor depasi\nlimita autorizata a terasei. <\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>VI.6.\nCOMERT AMBULANT CU PRODUSE SPECIFICE UNOR EVENIMENTE SI ACTIVITATI ORGANIZATE\nCU OCAZIA UNOR EVENIMENTE<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 44.&nbsp;&nbsp; Cu ocazia unor evenimente organizate in Orasul\nJibou,&nbsp; respectiv perioadele de la art.\n5.2 ( activitati comerciale ocazionale), 5.3 (activitati cu caracter social, de\ninteres public), 5.4 (activitati cu caracter cultural), 5.5 (activitati de\nagrement) &nbsp;in zonele publice&nbsp; delimitate ale municipalitatii se poate\nautoriza comercializarea unor produse specifice : martisoare, ravase, miniaturi\nreprezentative , bete Sf. Nicolae, candele, etc . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 45.&nbsp;\nNumarul de amplasamente , perioada , conditiile&nbsp; se&nbsp;\nvor&nbsp; aviza de catre Biroul\nUrbanism si Amenajarea Teritoriului din cadrul Primariei UAT Oras Jibou.&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 46.&nbsp;\nOcuparea amplasamentelor se face la cererea comerciantilor interesati,\ndepusa in termenul stabilit in anuntul public comunicat cu acest prilej (prin\nafisaj la Primarie sau difuzat prin alte mijloace). <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amplasamentele se atribuie in limita spatiului\ndisponibil si in ordinea cererilor inregistrate la secretariat cu conditia\nrespectarii tuturor exigentelor stabilite de catre administratia locala in\nprogramul evenimentului . <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 47. Pentru amplasamentele atribuite\nse datoreaza taxa de ocupare a domeniului public , taxa&nbsp; stabilita in conformitate cu valoarea\nprevazuta prin Hotarare a Consiliului Local&nbsp;\nprivind impozitele si taxele locale.&nbsp;&nbsp;&nbsp;\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CAPITOLUL VI <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>CONTRAVENTII SI SANCTIUNI <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Art. 48.&nbsp;&nbsp;&nbsp; In cazul incalcarii prevederilor\nprezentului regulament, contraventiile se constata si se aplica de catre\nagentii constatatori ai Politiei Locale. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anexa 1.&nbsp; la Regulament aprobat prin HCL nr.26\/2019<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Documente\nnecesare pentru avizarea activitatii de comert stradal in zona publica a\nOrasului Jibou&nbsp; <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp; <strong>1.
