(3) din Ordonan\u0163a de urgen\u0163\u0103 a Guvernului nr. 57\/2019 privind\nCodul administrativ, cu complet\u0103rile ulterioare,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Prevederile Legii nr. 273\/2006 privind\nfinan\u0163ele publice locale, cu modific\u0103rile \u015fi complet\u0103rile ulterioare;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u00cen temeiul art. 129 alin. (1) alin.\n2 lit. a), art.139 alin.(1), art. 196 alin. (1) lit. a) din Ordonan\u0163a de\nurgen\u0163\u0103 a Guvernului nr. 57\/2019 privind Codul administrativ, cu complet\u0103rile\nulterioare,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>HOT\u0102R\u0102\u0218TE:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;<strong>Art.1 <\/strong>Se\naprob\u0103 Regulamentul cadru de \u00eenchiriere a terenurilor \u015fi spa\u0163iilor disponibile\nexcedentare din unit\u0103\u0163ile de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat de pe raza\nteritorial-administrativ\u0103 a ora\u0219ului Jibou,conform Anexei parte integranta din\nprezenta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;<strong>Art.2 <\/strong>Consiliul\nLocal al ora\u0219ului Jibou mandateaz\u0103 conducerea unit\u0103\u021bilor de \u00eenv\u0103\u021b\u0103m\u00e2nt s\u0103\norganizeze procedura de \u00eencheiriere potrivit prevederilor prezentului\nRegulament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Art.3<\/strong>\nSe aprob\u0103 ca unit\u0103\u021bile de \u00eenv\u0103\u021b\u0103m\u00e2nt, \u00een calitate de titulare ale dreptului de\nadministrare, sa re\u021bin\u0103 din chirie o cot\u0103-parte de 50%, sum\u0103 ce reprezint\u0103\nvenit propriu, cealalt\u0103 cot\u0103 de 50% urm\u00e2nd a fi virat\u0103 \u00een contull de venituri\nal bugetului local al ora\u0219ului Jibou.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Art.4<\/strong>\nSe aprob\u0103 modelul cadru al Contractului de \u00eenchiriere pentru terenurile \u0219i\nspa\u021biile disponibile excedentare din unit\u0103\u021bile de \u00eenv\u0103\u021b\u0103m\u00e2nt&nbsp; preuniversitar de stat de pe raza ora\u0219ului\nJibou, prev\u0103zut \u00een Regulament parte integrant\u0103 din prezenta hot\u0103r\u00e2re.\nContractele de \u00eenchiriere&nbsp; pentru\nperioada de timp fractionat \u00een interiorul unei zile\/ s\u0103pt\u0103m\u00e2ni \/luni vor fi\n\u00eencheiate de c\u0103tre conduc\u0103torul unit\u0103\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt, cu respectarea\nlegisla\u021biei \u00een vigoare. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;<strong>Art.5<\/strong>\nCu ducerea la \u00eendeplinire a prezentei se&nbsp;\n\u00eencredin\u021beaz\u0103&nbsp; unit\u0103\u021bile de\n\u00eenv\u0103\u021b\u0103m\u00e2nt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Art.6<\/strong>&nbsp; Prezenta se comunic\u0103\ncu:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; -Domnul Primar&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Obiectul prezentului regulament \u00eel constituie reglementarea \u00eenchirierii prin licita\u0163ie public\u0103 a terenurilor \u015fi spa\u0163iilor disponibile excedentare din unit\u0103\u0163ile de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat de pe raza teritorial-administrativ\u0103 a ora\u0219ului Jibou.<\/p>\n<p><strong>Art.2.<\/strong> \u00cen accep\u0163iunea prezentului Regulament, prin spa\u0163ii disponibile excedentare ale unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat se \u00een\u0163elege : cl\u0103diri sau p\u0103r\u0163i ale acestora, s\u0103li de clas\u0103, ateliere, laboratoare, cantine, inclusiv dot\u0103rile aferente, construc\u0163iile demontabile (garaje, tonete), s\u0103li de sport, terenuri de sport \u015fi alte suprafe\u0163e de teren, care \u00een anumite perioade din timpul unui an, unei s\u0103pt\u0103m\u00e2ni sau luni nu sunt folosite \u00een procesul instructiv-educativ, etc.<\/p>\n<p><strong>Art.3.<\/strong> La sf\u00e2r\u015fitul fiec\u0103rui an \u015fcolar, Consiliile de Administra\u0163ie ale unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar vor inventaria spa\u0163iile excedentare \u015fi\/sau pretabile \u00eenchirierii urm\u00e2nd a transmite\u00a0 <strong>\u00a0Consiliului Local al ora\u0219ului Jibou<\/strong> o situa\u0163ie \u00een acest sens.<\/p>\n<p><strong>\u00a0Art.4.<\/strong> \u00cenchirierea se poate face numai \u00een scopul desf\u0103\u015fur\u0103rii unor activit\u0103\u0163i avizate de c\u0103tre Consiliile de administratie\u00a0 ale unit\u0103\u021bilor de \u00eenv\u0103t\u0103m\u00e2nt, care \u00eendeplinesc cumulativ urm\u0103toarele condi\u0163ii :<\/p>\n<ol>\n<li>a) ofer\u0103 \u015fi servicii ce r\u0103spund nemijlocit intereselor elevilor \u015fi cadrelor didactice;<\/li>\n<li>b) sunt aduc\u0103toare de venituri;<\/li>\n<li>c) prin tipul activit\u0103\u0163ilor desf\u0103\u015furate \u00een acestea nu \u00eempiedic\u0103 \u015fi nu contravin obiectivelor procesului instructiv-educativ \u015fi bunelor moravuri, nu promoveaz\u0103 idei antisociale;<\/li>\n<li>d) prin tipul activit\u0103\u0163ilor desf\u0103\u015furate \u00een acestea nu d\u0103uneaz\u0103 s\u0103n\u0103t\u0103\u0163ii \u015fi securit\u0103\u0163ii elevilor sau cadrelor didactice;<\/li>\n<li>e) prin tipul activit\u0103\u0163ilor desf\u0103\u015furate \u00een acestea nu servesc unor interese politice de partid;<\/li>\n<li>f) \u00een cazul \u00een care se comercializeaz\u0103 produse alimentare, acestea vor respecta principiile \u015fi dispozi\u0163iile legale privind alimenta\u0163ia s\u0103n\u0103toas\u0103.<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p><strong>\u00a0Art.5.<\/strong> Consiliul Local al ora\u0219ului Jibou mandateaz\u0103 conducerea unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt s\u0103 organizeze procedura de \u00eenchiriere, potrivit prevederilor prezentului Regulament.<\/p>\n<p>\u00a05.1<strong>.<\/strong> Principiile care stau la baza procedurii de \u00eenchiriere, respectiv a atribuirii contractelor de \u00eenchiriere sunt :<\/p>\n<ol>\n<li>a) transparen\u0163a &#8211; punerea la dispozi\u0163ia tuturor celor interesa\u0163i a informa\u0163iilor referitoare la aplicarea procedurii pentru atribuirea contractului de \u00eenchiriere;<\/li>\n<li>b) tratamentul egal &#8211; aplicarea, \u00eentr-o manier\u0103 nediscriminatorie, de c\u0103tre unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt, a criteriilor de atribuire a contractului de \u00eenchiriere a terenului\/spa\u0163iului disponibil excedentar din unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt;<\/li>\n<li>c) propor\u0163ionalitatea &#8211; orice m\u0103sur\u0103 stabilit\u0103 de unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt trebuie s\u0103 fie necesar\u0103 \u015fi corespunz\u0103toare naturii contractului;<\/li>\n<li>d) nediscriminarea &#8211; aplicarea de c\u0103tre unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt a acelora\u015fi reguli, indiferent de na\u0163ionalitatea participan\u0163ilor la procedura de atribuire a contractului de \u00eenchiriere, potrivit condi\u0163iilor prev\u0103zute \u00een acordurile \u015fi conven\u0163iile la care Rom\u00e2nia este parte;<\/li>\n<li>e) libera concuren\u0163\u0103 &#8211; asigurarea de c\u0103tre unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt a condi\u0163iilor pentru ca orice participant la procedura de atribuire s\u0103 aib\u0103 dreptul de a deveni chiria\u015f \u00een condi\u0163iile legii, ale conven\u0163iilor \u015fi acordurilor interna\u0163ionale la care Rom\u00e2nia este parte.<\/li>\n<\/ol>\n<p><strong>\u00a05.2.<\/strong> Autoritatea contractant\u0103 are obliga\u0163ia de a asigura protejarea acelor informa\u0163ii care \u00eei sunt comunicate de persoanele fizice sau juridice cu titlu confiden\u0163ial, \u00een m\u0103sura \u00een care, \u00een mod obiectiv, dezv\u0103luirea informa\u0163iilor \u00een cauz\u0103 ar prejudicia interesele legitime ale respectivelor persoane, inclusiv \u00een ceea ce prive\u015fte secretul comercial \u015fi proprietatea intelectual\u0103.<\/p>\n<p>\u00a0<strong>Art.6.<\/strong> Dup\u0103 adjudecarea licita\u0163iei \u015fi \u00eencheierea contractelor, acestea vor fi transmise de unit\u0103\u0163ile de \u00eenv\u0103\u0163\u0103m\u00e2nt, \u00een copie, <strong>\u00a0autorit\u0103\u0163ii locale<\/strong> pentru avizare.<\/p>\n<p><strong>Art.7.<\/strong> Unit\u0103\u0163ile de \u00eenv\u0103\u0163\u0103m\u00e2nt, \u00een calitate de titulare ale dreptului de administrare, vor re\u0163ine din chirie o cot\u0103 &#8211; parte de 50%, sum\u0103 ce reprezint\u0103 venit propriu, cealalt\u0103 cot\u0103 de 50% urm\u00e2nd a se vira \u00een contul de venituri al bugetului local al ora\u0219ului Jibou. Locatarii au obliga\u0163ia de a se conforma tuturor sarcinilor \u00een materie fiscal\u0103 (de declarare, de plat\u0103).<\/p>\n<p><strong>Art.8.<\/strong> \u00cen vederea ob\u0163inerii Acordului Consiliului local al ora\u0219ului Jibou, unit\u0103\u0163ile \u015fcolare vor depune urm\u0103toarele documente :<\/p>\n<ol>\n<li>a) Hot\u0103r\u00e2rea Consiliului de Administra\u0163ie a unit\u0103\u0163ii \u015fcolare cu men\u0163iunea expres\u0103 c\u0103 activitatea ce urmeaz\u0103 a fi desf\u0103\u015furat\u0103 \u00eentrune\u015fte condi\u0163iile prezentate la art. 4, respectiv men\u0163iunea c\u0103 aceasta nu afecteaz\u0103 programul de \u00eenv\u0103\u0163\u0103m\u00e2nt al unit\u0103\u0163ii \u015fcolare;<\/li>\n<li>b) Memoriu privind utilitatea activit\u0103\u0163ii.<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p><strong>Art.9.<\/strong> Contractele de \u00eenchiriere se \u00eencheie \u00eentre unit\u0103\u0163ile \u015fcolare \u015fi persoana care a fost desemnat\u0103 c\u00e2\u015ftig\u0103toare \u00een urma organiz\u0103rii licita\u0163iei, \u015fi vor fi avizate de c\u0103tre <strong>\u00a0ora\u0219ul Jibou .<\/strong><\/p>\n<p>\u00a0Locatarii sunt obliga\u0163i la plata utilit\u0103\u0163ilor consumate, ce se vor stabili\u00a0 de c\u0103tre unit\u0103\u0163ile \u015fcolare.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.10.<\/strong> Pre\u0163ul de pornire al licita\u0163iei va fi stabilit de Consiliul de administra\u0163ie al fiec\u0103rei unit\u0103\u0163i de \u00eenv\u0103\u0163\u0103m\u00e2nt pornind de la un tarif minimal stabilit conform regulamentului dup\u0103 cum urmeaz\u0103 :<\/p>\n<ol>\n<li>a) Pentru \u00eenchirierea cantinelor \u015fi s\u0103lilor de mese, \u00een vederea organiz\u0103rilor de nun\u0163i, botezuri sau alte evenimente asem\u0103n\u0103toare :<\/li>\n<\/ol>\n<p>\u00a0&#8211; tariful de \u00eenchiriere va fi de minim 500 lei\/eveniment\/zi.\u00a0<\/p>\n<ol>\n<li>b) Pentru \u00eenchirierea terenurilor de fotbal, s\u0103lilor de sport \u0219i s\u0103li de clas\u0103 (ore) :<\/li>\n<\/ol>\n<p>&#8211; tarif de \u00eenchiriere a terenurilor de fotbal va fi de minim 20 lei\/or\u0103;<\/p>\n<p>\u00a0&#8211; tarif de \u00eenchiriere a s\u0103lilor de sport va fi de minim 30 lei\/or\u0103;\u00a0\u00a0<\/p>\n<p>&#8211; tarif de \u00eenchiriere a s\u0103lilor de clas\u0103 va fi de minim 10 lei\/or\u0103;\u00a0<\/p>\n<ol>\n<li>c) Pentru \u00eenchirierea spa\u0163iilor situate \u00een incinta unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat c\u0103tre societ\u0103\u0163i comerciale (bufete de incint\u0103, ateliere, ), I.I., I.F. \u015fi alte asocia\u0163ii legal constituite, cu excep\u0163ia asocia\u0163iei de p\u0103rin\u0163i a unit\u0103\u0163ii respective;<\/li>\n<\/ol>\n<p>\u00a0&#8211; tariful de 30 lei\/m\u00b2\/lun\u0103 pentru spa\u0163ii situate \u00een cl\u0103direa unit\u0103\u0163ii;<\/p>\n<p>&#8211; tariful de 25 lei\/m\u00b2\/lun\u0103 pentru teren \u00een vederea amplas\u0103rii de chio\u015fc alimentar \u00een curtea unit\u0103\u0163ii;\u00a0<\/p>\n<p>&#8211;\u00a0 tariful de 50 lei\/m\u00b2\/lun\u0103 pentru aparate de cafea, produse alimentare.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.11.<\/strong> \u00cen cazurile contractelor de \u00eenchiriere, care au \u00eencetat anterior prezentului regulament, \u015fi pentru care a operat tacita reloca\u0163iune, aceasta va fi denun\u0163at\u0103 de unit\u0103\u0163ile \u015fcolare \u00een termen de 30 de zile de la aprobarea regulamentului, urm\u00e2nd a fi aplicabile procedurilor instituite \u00een cadrul prezentului Regulament.<\/p>\n<p>\u00a0<strong>Art.12.<\/strong> Restric\u0163ii aplicabile :<\/p>\n<ol>\n<li>a) Nu pot face obiectul \u00eenchirierii s\u0103lile de clas\u0103 \u015fi cabinetele unit\u0103\u0163ilor al c\u0103ror proces instructiv-educativ este organizat \u00een dou\u0103 sau peste dou\u0103 schimburi, s\u0103lile de clas\u0103 temporar disponibile care sunt solicitate de c\u0103tre alte unit\u0103\u0163i de \u00eenv\u0103\u0163\u0103m\u00e2nt pentru desf\u0103\u015furarea procesului instructiv-educativ, atelierele, cabinetele, laboratoarele, s\u0103lile de sport \u015fi terenurile sportive, precum \u015fi baza material\u0103 aferent\u0103 acestora, \u00een care se desf\u0103\u015foar\u0103 activitatea didactic\u0103 \u00een interiorul programului propriu al unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt;<\/li>\n<li>b) Este interzis\u0103 reamenajarea spa\u0163iilor \u00een vederea \u00eenchirierii dac\u0103, prin modific\u0103rile efectuate se obtureaz\u0103 c\u0103ile de acces \u015fi defluire;<\/li>\n<li>c) Este interzis\u0103 sub\u00eenchirierea sau cedarea de c\u0103tre chiria\u015fi a spa\u0163iilor sau mijloacelor \u00eenchiriate de la unit\u0103\u0163ile de \u00eenv\u0103\u0163\u0103m\u00e2nt.<\/li>\n<\/ol>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art.13.<\/strong> Procedura aplicabil\u0103 \u00een cazul \u00een care \u00eenchirierea vizeaz\u0103 spa\u0163ii disponibile excedentare pentru a face obiectul \u00eenchirierii <strong><em>pentru perioade de timp frac\u0163ionat \u00een interiorul unei zile\/s\u0103pt\u0103m\u00e2ni\/luni<\/em><\/strong><\/p>\n<p>13.1. Pentru aceste cazuri, Consiliul Local al ora\u0219ului Jibou mandateaz\u0103 conducerea unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt s\u0103 organizeze procedura de \u00eenchiriere dup\u0103 ob\u0163inerea avizului Consiliului de Administra\u0163ie \u015fi , nefiind necesar acordul Consiliului Local al ora\u0219ului Jibou.<\/p>\n<p>13.2. Perioada de \u00eenchiriere nu va fi mai mare de 4 ani de la data hot\u0103r\u00e2rii adjudec\u0103rii licita\u0163iei, cu posibilitatea prelungirii acesteia cu o perioad\u0103 egal\u0103 cu perioada ini\u0163ial\u0103, o singur\u0103 dat\u0103, cu acordul prealabil al Consiliului de Administra\u0163ie al unit\u0103\u0163ii de \u00eenv\u0103\u0163\u0103m\u00e2nt.<\/p>\n<p>13.3. \u00cenchirierea s\u0103lilor de sport este posibil\u0103 doar pentru intervalul de timp excedentar\u00a0 cu avizul Consiliului de administra\u021bie.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<strong>Art.14.<\/strong> Procedura aplicabil\u0103 \u00een cazul \u00een care \u00eenchirierea vizeaz\u0103 spa\u0163ii disponibile excedentare, \u015fi care nu sunt afectate de procesul de \u00eenv\u0103\u0163\u0103m\u00e2nt (<strong><em>loca\u0163iune f\u0103r\u0103 timpi frac\u0163iona\u0163i)<\/em><\/strong> .<\/p>\n<p>14.1. Pentru aceste cazuri, Consiliul Local al ora\u0219ului Jibou mandateaz\u0103 conducerea unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt s\u0103 organizeze procedura de \u00eenchiriere dup\u0103 ob\u0163inerea Avizului Consiliului de Administra\u0163ie \u015fi , fiind necesar \u015fi acordul Consiliului Local al ora\u0219ului Jibou .<\/p>\n<p>14.2. Perioada de \u00eenchiriere nu va fi mai mare de 4 ani, cu posibilitatea prelungirii acesteia cu o perioad\u0103 egal\u0103 cu perioada ini\u0163ial\u0103, o singur\u0103 dat\u0103, cu acordul prealabil al Consiliului de administra\u0163ie al unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt.<\/p>\n<p><strong>Art.15.<\/strong>\u00a0\u00a0 Unit\u0103\u0163ile \u015fcolare de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat care de\u0163in terenuri\/s\u0103li de sport, nu vor proceda la \u00eenchirierea acestora dec\u00e2t \u00een condi\u0163iile \u00een care \u00eenchirierea nu impiedic\u0103 \u0219i nu contravine obiectivelor procesului instructiv educative al elevilor .<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAPITOLUL II <\/strong><\/p>\n<p><strong>Documenta\u0163ia de atribuire<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>\u00a0<strong>Art.16.<\/strong> Documenta\u0163ia de atribuire se aprob\u0103 prin Hot\u0103r\u00e2re de Consiliu Local \u015fi va cuprinde cel pu\u0163in elementele prev\u0103zute <strong>\u00een anexa nr. 1<\/strong> la prezentul Regulament.Al\u0103turi de documenta\u021bia de atribuire se vor depune documentele prev\u0103zute la art.8.<\/p>\n<p>\u00a0<strong>Art.17.<\/strong> Dup\u0103 aprobarea H.C.L. se va proceda la organizarea licita\u0163iei publice de \u00eenchiriere a terenului \u015fi\/sau spa\u0163iului excedentar din unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat de pe raza teritorial-administrativ\u0103 a ora\u0219ului Jibou, care face parte integrant\u0103 din documenta\u0163ia de atribuire \u00een care sunt precizate orice cerin\u0163\u0103, criteriu, regul\u0103 \u015fi alte informa\u0163ii ce sunt necesare pentru a asigura ofertantului o informare complet\u0103, explicit\u0103 \u015fi corect\u0103 cu privire la modul de aplicare a procedurii de licita\u0163ie.<\/p>\n<p><strong>Art.18.<\/strong> Autoritatea contractant\u0103 are dreptul de a impune \u00een cadrul documenta\u0163iei de atribuire, \u00een m\u0103sura \u00een care acestea sunt compatibile cu bunul care se \u00eenchiriaz\u0103, condi\u0163ii speciale de \u00eendeplinire a contractului prin care se urm\u0103re\u015fte ob\u0163inerea unor efecte de ordin social sau \u00een leg\u0103tur\u0103 cu protec\u0163ia mediului \u015fi promovarea dezvolt\u0103rii durabile.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAPITOLUL III<\/strong><\/p>\n<p><strong>Instruc\u0163iuni privind organizarea \u015fi desf\u0103\u015furarea procedurii de licita\u0163ie public\u0103 pentru \u00eenchiriere<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art.19.<\/strong> Licita\u0163ia public\u0103 este procedura la care orice persoan\u0103 fizic\u0103, persoan\u0103 fizic\u0103 autorizat\u0103 sau juridic\u0103 interesat\u0103 are dreptul de a depune oferta \u00een condi\u0163iile respect\u0103rii prevederilor documenta\u0163iei de atribuire, respectiv pentru \u00eenchirierea bunurilor disponibile excedentare din unit\u0103\u0163ile de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat de pe raza ora\u0219ului Jibou, \u00een condi\u0163iile legii.<\/p>\n<p><strong>Art.20<\/strong>. Licita\u0163ia public\u0103 se organizeaz\u0103 de unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt prin comisia de organizare a licita\u0163iei constituit\u0103 la nivelul unit\u0103\u0163ii de \u00eenv\u0103\u0163\u0103m\u00e2nt prin decizia directorului acesteia. Din comisie va face parte reprezentantul Primarului ora\u0219ului Jibou \u00een Consiliul de Administra\u0163ie al respectivei unit\u0103\u0163i de \u00eenv\u0103\u0163\u0103m\u00e2nt \u015fi\/sau al aparatului de specialitate.<\/p>\n<p>\u00a020.1. \u00cen vederea declan\u015f\u0103rii procedurii de licita\u0163ie public\u0103 se va ob\u0163ine<strong>, dup\u0103 caz<\/strong> :<\/p>\n<ol>\n<li>a) Acordul Consiliului de Administra\u0163ie al unit\u0103\u0163ii de \u00eenv\u0103\u0163\u0103m\u00e2nt;<\/li>\n<\/ol>\n<p>b)Acordul Consiliului Local al ora\u0219ului Jibou ;<\/p>\n<ol>\n<li><strong>c)<\/strong> Avizul Inspectoratului \u015ecolar Jude\u0163ean S\u0103laj;<\/li>\n<li><strong>d)<\/strong> Avizul conform al ministrului educa\u0163iei na\u0163ionale privind schimbarea destina\u0163iei unor imobile &#8211; construc\u0163ii, teren aferent, etc., ce apar\u0163in unit\u0103\u0163ilor de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat.<\/li>\n<\/ol>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Avizele prev\u0103zute la art.20,pct 20.1 litera c \u0219i d se vor obtine numai \u00een cazul schimb\u0103rii destinatiei unor immobile din unit\u0103\u021bile de \u00eenv\u0103t\u0103mant preuniversitar.<\/p>\n<p>\u00a020.2. Dup\u0103 ob\u0163inerea Acordului Consiliului Local al ora\u0219ului Jibou \u015fi\/sau ( dup\u0103 caz )\u00a0 Avizul Inspectoratului \u015ecolar Jude\u0163ean S\u0103laj \u015fi al Ministerului Educa\u0163iei Na\u0163ionale, Comisia de licita\u0163ie va \u00eentocmi anun\u0163ul privind organizarea licita\u0163iei. Anun\u0163ul privind organizarea licita\u0163iei va fi transmis spre publicare Monitorului Oficial al Rom\u00e2niei ,partea VI,\u00eentrun cotidian de crculatie national ,\u00eentr-un cotidian de circula\u0163ie local\u0103 \u015fi pe site-ul unit\u0103\u0163ii \u015fcolare cu cel pu\u0163in 20 de zile calendaristice \u00eenainte de data-limit\u0103 pentru depunerea ofertelor.<\/p>\n<p>\u00a020.3. Anun\u0163ul de licita\u0163ie va cuprinde cel pu\u0163in urm\u0103toarele elemente :<\/p>\n<ol>\n<li>a) informa\u0163ii generale privind autoritatea contractant\u0103, precum : denumirea, codul de identificare fiscal\u0103, adresa, datele de contact, persoana de contact;<\/li>\n<li>b) informa\u0163ii generale privind obiectul procedurii de licita\u0163ie public\u0103, \u00een special descrierea \u015fi identificarea bunului care urmeaz\u0103 s\u0103 fie \u00eenchiriat;<\/li>\n<li>c) informa\u0163ii privind documenta\u0163ia de atribuire : modalitatea sau modalit\u0103\u0163ile prin care persoanele interesate pot intra \u00een posesia unui exemplar al documenta\u0163iei de atribuire, denumirea \u015fi datele de contact ale serviciului\/compartimentului din cadrul autorit\u0103\u0163ii contractante de la care se poate ob\u0163ine un exemplar din documenta\u0163ia de atribuire, costul \u015fi condi\u0163iile de plat\u0103 pentru ob\u0163inerea documenta\u0163iei, dac\u0103 este cazul, data-limit\u0103 pentru solicitarea clarific\u0103rilor;<\/li>\n<li>d) informa\u0163ii privind ofertele : data-limit\u0103 de depunere a ofertelor, adresa la care trebuie depuse acestea, num\u0103rul de exemplare \u00een care trebuie depus\u0103 fiecare ofert\u0103;<\/li>\n<li>e) data \u015fi locul la care se va desf\u0103\u015fura \u015fedin\u0163a public\u0103 de deschidere a ofertelor;<\/li>\n<li>f) instan\u0163a competent\u0103 \u00een solu\u0163ionarea eventualelor litigii \u015fi termenele pentru sesizarea instan\u0163ei; g) data transmiterii anun\u0163ului de licita\u0163ie c\u0103tre institu\u0163iile abilitate, \u00een vederea public\u0103rii.<\/li>\n<\/ol>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art.21<\/strong>. Orice persoan\u0103 interesat\u0103 are dreptul de a solicita \u015fi de a ob\u0163ine documenta\u0163ia de atribuire numai dup\u0103 ce achit\u0103 taxa de documentare, prevazut\u0103 \u00een documenta\u0163ia de atribuire. Taxa de documentare va fi stabilit\u0103 de Consiliul de Administra\u0163ie al unit\u0103\u0163ii \u015fcolare.<\/p>\n<p>21.1. Documenta\u021bia de atribuire va fi pus\u0103 la dispozi\u0163ia persoanei interesate care a \u00eenaintat o solicitare \u00een acest sens, \u00eentr-un exemplar, pe suport h\u00e2rtie, contra cost.<\/p>\n<p>21.2. Autoritatea contractant\u0103 are obliga\u0163ia s\u0103 asigure ob\u0163inerea documenta\u0163iei de atribuire de c\u0103tre persoana interesat\u0103, care \u00eenainteaz\u0103 o solicitare \u00een acest sens \u015fi a achitat taxa de documentare.<\/p>\n<p>21.3. Documentele necesare pentru \u00eenscrierea la licita\u0163ie, se depun la Secretariatul unit\u0103\u0163ii \u015fcolare.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.22<\/strong>. Autoritatea contractant\u0103 are obliga\u0163ia de a pune documenta\u0163ia de atribuire la dispozi\u0163ia persoanei interesate c\u00e2t mai repede posibil, \u00eentr-o perioad\u0103 care nu trebuie s\u0103 dep\u0103\u015feasc\u0103 4 zile lucr\u0103toare de la primirea unei solicit\u0103ri din partea acesteia.<\/p>\n<p>22.1. Persoana interesat\u0103 are obliga\u0163ia de a depune diligen\u0163ele necesare, astfel \u00eenc\u00e2t respectarea de c\u0103tre autoritatea contractant\u0103 a perioadei prev\u0103zute mai sus s\u0103 nu conduc\u0103 la situa\u0163ia \u00een care documenta\u0163ia de atribuire s\u0103 fie pus\u0103 la dispozi\u0163ia sa cu mai pu\u0163in de 5 zile lucr\u0103toare \u00eenainte de data-limit\u0103 pentru depunerea ofertelor.<\/p>\n<p>22.2. Persoana interesat\u0103 are dreptul de a solicita clarific\u0103ri privind documenta\u0163ia de atribuire.<\/p>\n<p>\u00a022.3. Autoritatea contractant\u0103 are obliga\u0163ia de a r\u0103spunde \u00een mod clar, complet \u015fi f\u0103r\u0103 ambiguit\u0103\u0163i, la orice clarificare solicitat\u0103, \u00eentr-o perioad\u0103 care nu trebuie s\u0103 dep\u0103\u015feasc\u0103 5 zile lucr\u0103toare de la primirea unei astfel de solicit\u0103ri.<\/p>\n<p>22.4. Autoritatea contractant\u0103 are obliga\u0163ia de a transmite r\u0103spunsurile \u00eenso\u0163ite de \u00eentreb\u0103rile aferente c\u0103tre toate persoanele interesate care au ob\u0163inut, \u00een condi\u0163iile legii, documenta\u0163ia de atribuire, lu\u00e2nd m\u0103suri pentru a nu dezv\u0103lui identitatea celui care a solicitat clarific\u0103rile respective.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<strong>Art.23.<\/strong> F\u0103r\u0103 a aduce atingere prevederilor de mai sus, autoritatea contractant\u0103 are obliga\u0163ia de a transmite r\u0103spunsul la orice clarificare cu cel pu\u0163in 5 zile lucr\u0103toare \u00eenainte de data-limit\u0103 pentru depunerea ofertelor. \u00cen cazul \u00een care solicitarea de clarificare nu a fost transmis\u0103 \u00een timp util, pun\u00e2nd astfel autoritatea contractant\u0103 \u00een imposibilitatea de a respecta termenul prev\u0103zut mai sus, acesta din urm\u0103 are totu\u015fi obliga\u0163ia de a r\u0103spunde la solicitarea de clarificare \u00een m\u0103sura \u00een care perioada necesar\u0103 pentru elaborarea \u015fi transmiterea r\u0103spunsului face posibil\u0103 primirea acestuia de c\u0103tre persoanele interesate \u00eenainte de data-limit\u0103 de depunere a ofertelor.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.24.<\/strong> Procedura de licita\u0163ie se poate desf\u0103\u015fura numai dac\u0103, \u00een urma public\u0103rii anun\u0163ului de licita\u0163ie, au fost depuse cel pu\u0163in dou\u0103 oferte valabile.<\/p>\n<p>\u00a024.1. \u00cen cazul \u00een care, \u00een urma public\u0103rii anun\u0163ului de licita\u0163ie nu au fost depuse cel pu\u0163in dou\u0103 oferte valabile, autoritatea contactant\u0103 este obligat\u0103 s\u0103 anuleze procedura \u015fi s\u0103 organizeze o nou\u0103 licita\u0163ie. 24.2. Pentru cea de-a doua licita\u0163ie va fi p\u0103strat\u0103 documenta\u0163ia de atribuire aprobat\u0103 pentru prima licita\u0163ie, iar licita\u0163ia va fi organizat\u0103 \u00een acelea\u015fi condi\u0163ii.<\/p>\n<p>\u00a0<\/p>\n<p><em>24.3.<\/em><em>\u00a0\u00cen cazul \u00een care \u00een urma public\u0103rii anun\u021bului de licita\u021bie nu au fost depuse cel pu\u021bin dou\u0103 oferte valabile, autoriatea contractanta este obligat\u0103 s\u0103 anuleze procedura \u0219i s\u0103 organizeze o nou\u0103 licita\u021bie, cu respectarea procedurii prev\u0103zute \u00een documentatia de atribuire.Sunt considerate oferte valabile ofertele care indeplinesc criteriilede atribuire\/valabilitate prevazute \u00een documenta\u021bie.Daca este depus\u0103 o singura oferta la prima licitatie,ofertantul prezent poate opta pentru mentinerea ofertei sale pentru noua licita\u021bie la sediul autoritatii contractante sau retragerea acesteia.In prima situatie <\/em>toate documentele depuse \u015fi taxele achitate se men\u0163in, p\u0103str\u00e2ndu-se depuse la sediul organizatorului<em>\u00a0 dar in cazul expirarii termenului de valabilitate a unuia din actele depuse ofertantul\u00a0 va prezenta noile documente valabile la data urm\u0103toarei licitatii .<\/em> \u00cen cea de-a doua situa\u0163ie, i se va restitui oferta.<\/p>\n<p><em>24.4<strong>. <\/strong>In situatia \u00een care ,la cea de a doua procedur\u0103 de licitatie s-a depus o singur\u0103 ofert\u0103\u00a0 \u0219i aceasta este valabil\u0103 sau au fost depuse mai multe oferte dintre care una singur\u0103 este valabila,autoritatea contractant\u0103\u00a0 va atribui contractul celui\/celei care a depus respectiva ofert\u0103 valabil\u0103.<\/em><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>CAPITOLUL IV <\/strong><\/p>\n<p><strong>Participan\u0163ii la licita\u0163ie<\/strong><\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.25.<\/strong> Are dreptul de a participa la licita\u0163ie orice persoan\u0103 fizic\u0103, persoan\u0103 fizic\u0103 autorizat\u0103 sau juridic\u0103, rom\u00e2n\u0103 sau str\u0103in\u0103, care \u00eendepline\u015fte urm\u0103toarele condi\u0163ii :<\/p>\n<ol>\n<li>a) a achitat taxa de documentare (achizi\u0163ionarea caietului de sarcini) privind participarea la licita\u0163ie, inclusiv garan\u0163ia de participare la licita\u0163ie \u00een cuantumul prev\u0103zut \u00een Caietul de sarcini;<\/li>\n<li>b) a depus oferta de participare la licita\u0163ie, \u00eempreun\u0103 cu toate documentele solicitate \u00een documenta\u0163ia de atribuire, \u00een termenele prev\u0103zute \u00een anun\u0163ul de licita\u021bie;<\/li>\n<li>c) are \u00eendeplinite la zi toate obliga\u0163iile exigibile de plat\u0103 a impozitelor, taxelor \u015fi contribu\u0163iilor c\u0103tre bugetul local \u0219i bugetul de stat ;<\/li>\n<li>d) nu este \u00een stare de insolven\u0163\u0103, faliment sau lichidare.<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p><strong>\u00a0Art.26.<\/strong> Documentatia de atribuire se va intocmi de unitatea de \u00eenv\u0103t\u0103m\u00e2nt (caiet de sarcini,instructiuni privind modul de elaborarea si prezentare a ofertelor \u2013criteriile de valabilitate ,contractual cadru formulare )\u00a0\u00a0 ,se va aviza de Consiliul de Administra\u021bie\u00a0 a unit\u0103\u021bii \u0219colare \u0219i se va supune aprob\u0103rii Consiliului Local.<\/p>\n<p>26.1. Persoanele desemnate s\u0103 fac\u0103 parte din Comisia de licita\u0163ie vor da o declara\u0163ie pe propria r\u0103spundere cu privire la faptul c\u0103 nu se afl\u0103 \u00een situa\u0163ii de incompatibilitate.<\/p>\n<p>26.2. Comisia de evaluare a ofertelor\u00a0 nu poate fi mai mica de 5 membrii \u0219i va lucra legal \u00een prezen\u0163a majorit\u0103\u0163ii membrilor s\u0103i. Deciziile vor fi luate de Comisia de evaluare\u00a0 cu votul majorit\u0103\u0163ii membrilor. Licita\u0163ia este condus\u0103 de pre\u015fedintele Comisiei de licita\u0163ie.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAPITOLUL V<\/strong><\/p>\n<p><strong>\u00a0Instruc\u0163iuni privind modul de elaborare \u015fi prezentare a ofertelor &#8211; criterii de valabilitate ale ofertei<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>\u00a0<strong>Art.27.<\/strong> Persoana interesat\u0103 are obliga\u0163ia de a depune oferta la adresa \u015fi p\u00e2n\u0103 la data-limit\u0103 pentru depunere, stabilite \u00een anun\u0163ul procedurii.<\/p>\n<p>27.1. Oferta are valabilitatea de 90 zile \u0219i se depune la sediul unit\u0103\u0163ii \u015fcolare, \u00eentr-un singur exemplar, semnat de ofertant, exemplar ce con\u0163ine dou\u0103 plicuri sigilate, unul exterior \u015fi unul interior, care se \u00eenregistreaz\u0103 la Secretariatul unit\u0103\u0163ii \u015fcolare, \u00een ordinea primirii, preciz\u00e2ndu-se data \u015fi ora \u015fi va con\u0163ine urm\u0103toarele elemente :<\/p>\n<ol>\n<li><strong>A) 1 Persoane juridice<\/strong><\/li>\n<\/ol>\n<p><strong>\u00a0Pe plicul exterior<\/strong> se va indica obiectul licita\u0163iei, terenul \u015fi\/sau spa\u0163iul disponibil excedentar din unitatea de \u00eenv\u0103\u0163\u0103m\u00e2nt preuniversitar de stat &#8211; lista cu elementele caracteristice pentru care este depus\u0103 oferta \u015fi va con\u0163ine :<\/p>\n<p>\u00a0<\/p>\n<p>1)documente de certificare a identitatii si calitatii ofertantului:<\/p>\n<p>&#8211;\u00a0 fisa de informatii privind ofertantul\u00a0 \/ declaratia de participare privind ofertantul semnat\u0103 ,f\u0103r\u0103 \u00eengros\u0103turi ,\u015fters\u0103turi sau modificari conform\u00a0 formular\u00a0 <strong>litera\u00a0 A<\/strong> ;<\/p>\n<p>-certificatul de inmatriculare emis de Oficiu Registrului Comertului &#8211; copie;<\/p>\n<p>-certificatul constatator, emis de Oficiul Registrului Comertului, eliberat, cu cel mult 30 de zile inainte de data deschiderii ofertelor,\u00a0 copie certificata de ofertant conform cu originalul;<\/p>\n<p>-copie certificata de ofertant conform cu originalul dupa statutul si actul constitutiv al persoanei juridice, cu actele aditionale semnificative;<\/p>\n<p>-declaratie pe proprie raspundere a reprezentantului legal al persoanei juridice ca nu se afla in dizolvare, insolventa, faliment sau lichidare-original, potrivit <strong>formularului litera B<\/strong>, insotita de copie a dovezii privind calitatea sa de reprezentant legal al persoanei juridice si a actului sau de identitate;<\/p>\n<p>-imputernicire in original acordata persoanei care reprezinta ofertantul in cadrul procedurii de licitatie publica, insotita de copie a actului sau de identitate; &#8211; \u00eemputernicirea se prezint\u0103 numai\u00a0 pentru reprezentan\u0163ii ofertantilor daca acestia nu pot fi prezenti.<\/p>\n<p>&#8211; certificat constatator privind plata obligatiilor c\u0103tre bugetul consolidatde stat eliberat de D.G.F.P.din care s\u0103 reias\u0103 faptul c\u0103 ofertantul\u00a0 nu are datorii catre bugetul de stat,valabil la data deschiderii ofertelor\u00a0 \u00een original sau copie legalizat\u0103.<\/p>\n<p>&#8211; (adeverinte de venit \/ declarartii pe propria raspundere\/document emis de unitati bancare din care sa reiasa faptul ca despune de\u00a0 resurse financiare pentru inchirierea imobilului\u00a0 (<strong>se puncteaza cu 30 puncte ) ,<\/strong><\/p>\n<p><strong>c)<\/strong>protec\u021bia mediului \u00eenconjur\u0103tor- Declara\u021bia chiria\u0219ului privind problemele de mediu \u2013 <strong>Formular nr.II<\/strong>\u00a0 \u2013 (<strong>se puncteaza cu 10 puncte) ;<\/strong><\/p>\n<ol>\n<li><strong>d<\/strong>) conditii specifice impuse de natura bunului de \u00eenchiriat &#8211; formularul conditiilor impuse se va intocmi de unitatea scolara Formular nr.III(<strong>se puncteaza cu 20 puncte)<\/strong><\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p><strong>C)Taxele\u00a0 \u0219i garantiile prevazute in documentatia de atribuire precum \u0219i punctajul privind criteriile de atribuire a contractului de \u00eenchiriere\u00a0 se poate modifica\u00a0 de consiliul de administratie al unitatii scolare \u00een functie de bunul supus inchirierii fara a fi supus aprobarii Consiliului local.In cadrul documenta\u021biei de atribuire se va include inclusiv algoritmul de calcul pentru fiecare criteriu \u00een parte.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>\u00a027.2. Persoanele fizice care nu pot participa la licita\u0163ia pentru care s-au \u00eenscris vor putea delega, o alt\u0103 persoan\u0103 major\u0103, s\u0103 le reprezinte la licita\u0163ia respectiv\u0103 printr-o \u00eemputernicire scris\u0103 \u00een acest sens \u015fi o copie a actului s\u0103u de identitate.<\/p>\n<p>\u00a027.3. Persoanele juridice care particip\u0103 la licita\u0163ie vor fi reprezentate de administrator sau, \u00een lipsa acestuia, de o alt\u0103 persoan\u0103 \u00een baza unei \u00eemputerniciri scrise \u00een acest sens.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Pe plicul interior<\/strong> se \u00eenscriu numele sau denumirea ofertantului, precum \u015fi domiciliul\/ re\u015fedin\u0163a\/sediul social principal sau sediul social al acestuia, dup\u0103 caz, iar \u00een plic se va introduce oferta propriu-zis\u0103 (anexa &#8211; model ofert\u0103), dup\u0103 caz.<\/p>\n<p>\u00a027.4. Oferta trebuie s\u0103 cuprind\u0103 condi\u0163iile prev\u0103zute \u00een caietul de sarcini \u015fi alte obliga\u0163ii pe care ofertantul \u015fi le asum\u0103 \u00een cazul \u00een care va c\u00e2\u015ftiga licita\u0163ia.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>\u00a027.5. Sunt considerate oferte valabile ofertele care \u00eendeplinesc criteriile de valabilitate prev\u0103zute \u00een documenta\u0163ia de atribuire conform art. 27, lit. A) Nr.1\u00a0 sau 2 ( functie de ofertant) la prezentul Regulament.<\/p>\n<p>27.6. Neprezenterea oric\u0103rui document prevazut la art. 27, lit. A), Nr.1\u00a0 sau 2 ( functie de ofertant la prezentul Regulament, atrage de drept eliminarea ofertelor respective din cadrul \u015fedin\u0163ei de licita\u0163ie.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art.28<\/strong>. Evaluarea ofertelor care vor participa la licita\u0163ie se face pe baza criteriilor de atribuire.<\/p>\n<p>28.1. Oferta c\u00e2\u015ftig\u0103toare este oferta care \u00eentrune\u015fte cel mai mare punctaj \u00een urma aplic\u0103rii criteriilor de atribuire. La punctaj egal va fi declarat c\u00e2\u015ftig\u0103tor, ofertantul cu oferta financiar\u0103 cea mai mare. \u00cen situa\u021bia \u00een care oferta financiar\u0103 este egal\u0103, departajarea se va face \u00een func\u0163ie de punctajul ob\u0163inut pe criteriul de atribuire care are ponderea cea mai mare dup\u0103 acesta.<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00a0Art.29.<\/strong> Pentru un amplasament, fiecare participant va depune o singur\u0103 ofert\u0103, redactat\u0103 \u00een limba roman\u0103.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art.30<\/strong>. Oferta are caracter obligatoriu, din punct de vedere al con\u0163inutului, pe toat\u0103 perioada de valabilitate stabilit\u0103 de autoritatea contractant\u0103. Ofertantul care solicit\u0103 retragerea ofertei pe perioada de valabilitate a acesteia, pierde garan\u0163ia de participare \u015fi calitatea de ofertant.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art.31.<\/strong> Persoana interesat\u0103 are obliga\u0163ia de a depune oferta la adresa \u015fi p\u00e2n\u0103 la data-limit\u0103 pentru depunere, stabilite \u00een anun\u0163ul procedurii. Riscurile legate de transmiterea ofertei, inclusiv for\u0163a major\u0103, cad \u00een sarcina persoanei interesate.<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00a0Art.32.<\/strong> Oferta depus\u0103 la o alt\u0103 adres\u0103 a autorit\u0103\u0163ii contractante dec\u00e2t cea stabilit\u0103 sau dup\u0103 expirarea datei-limit\u0103 pentru depunere se returneaz\u0103 nedeschis\u0103.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.33.<\/strong> Con\u0163inutul ofertelor trebuie s\u0103 r\u0103m\u00e2n\u0103 confiden\u0163ial p\u00e2n\u0103 la data stabilit\u0103 pentru deschiderea acestora, autoritatea contractant\u0103 urm\u00e2nd a lua cuno\u015ftin\u0163\u0103 de con\u0163inutul respectivelor oferte numai dup\u0103 aceast\u0103 dat\u0103.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0Art.34<\/strong>. Ofertan\u0163ilor declara\u0163i nec\u00e2\u015ftig\u0103tori, la solicitarea scris\u0103, li se va restitui garan\u0163ia \u00een termen de 7 zile de la desemnarea ofertantului c\u00e2\u015ftig\u0103tor.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAPITOLUL VI<\/strong><\/p>\n<p><strong>\u00a0Anularea procedurii de licita\u0163ie<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0Art.35.<\/strong> Autoritatea contractant\u0103 are obliga\u0163ia de a \u00eencheia contractul cu ofertantul a c\u0103rui ofert\u0103 a fost stabilit\u0103 ca fiind c\u00e2\u015ftig\u0103toare. Prin excep\u0163ie, autoritatea contractant\u0103 are dreptul de a anula procedura pentru atribuirea contractului de \u00eenchiriere \u00een situa\u0163ia \u00een care se constat\u0103 abateri grave de la prevederile legale care afecteaz\u0103 procedura de licita\u0163ie sau fac imposibil\u0103 \u00eencheierea contractului.<\/p>\n<p>35.1. \u00cen sensul prevederilor legale, procedura de licita\u0163ie se consider\u0103 afectat\u0103 \u00een cazul \u00een care sunt \u00eendeplinite \u00een mod cumulativ urm\u0103toarele condi\u0163ii :<\/p>\n<ol>\n<li>a) \u00een cadrul documenta\u0163iei de atribuire \u015fi\/sau \u00een modul de aplicare a procedurii de licita\u0163ie se constat\u0103 erori sau omisiuni care au ca efect \u00eenc\u0103lcarea principiilor prev\u0103zute la art. 5 din prezentul Regulament;<\/li>\n<li>b) autoritatea contractant\u0103 se afl\u0103 \u00een imposibilitatea de a adopta m\u0103suri corective, f\u0103r\u0103 ca acestea s\u0103 conduc\u0103, la r\u00e2ndul lor, la \u00eenc\u0103lcarea principiilor prev\u0103zute la art. 5 din prezentul Regulament.<\/li>\n<\/ol>\n<p>\u00a035.2. \u00cenc\u0103lcarea prevederilor prezentei sec\u0163iuni privind atribuirea contractului poate atrage anularea procedurii, potrivit dispozi\u0163iilor legale \u00een vigoare.<\/p>\n<p>35.3. Autoritatea contractant\u0103 are obliga\u0163ia de a comunica, \u00een scris, tuturor participan\u0163ilor la procedura de licita\u0163ie, \u00een cel mult 3 zile lucr\u0103toare de la data anul\u0103rii, at\u00e2t \u00eencetarea obliga\u0163iilor pe care ace\u015ftia \u015fi\u00a0\u00a0\u00a0\u00a0 le-au creat prin depunerea ofertelor, c\u00e2t \u015fi motivul concret care a determinat decizia de anulare.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAPITOLUL VII<\/strong><\/p>\n<p><strong>\u00a0Solu\u0163ionarea contesta\u0163iilor\/litigiilor<\/strong><\/p>\n<p>\u00a0<\/p>\n<p><strong>Art. 36.<\/strong> Orice persoan\u0103 care se consider\u0103 v\u0103t\u0103mat\u0103 \u00eentr-un drept ori \u00eentr-un interes legitim printr-un act al autorit\u0103\u0163ii contractante, se poate adresa instan\u0163ei de contencios administrativ competente, pentru anularea actului, obligarea autorit\u0103\u0163ii contractante de a emite un act, recunoa\u015fterea dreptului pretins sau a interesului legitim, \u00een condi\u0163iile prev\u0103zute de Legea nr. 554\/2004 a contenciosului administrativ, cu modific\u0103rile \u015fi complet\u0103rile ulterioare.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAPITOLUL VIII<\/strong><\/p>\n<p><strong>\u00a0\u00cencheierea contractului de \u00eenchiriere<\/strong><\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<strong>Art.37.<\/strong> Autoritatea contractant\u0103 are obliga\u0163ia de a \u00eencheia contractul de \u00eenchiriere cu ofertantul a c\u0103rui ofert\u0103 a fost stabilit\u0103 ca fiind c\u00e2\u015ftig\u0103toare.<\/p>\n<p>37.1. Autoritatea contractant\u0103 poate s\u0103 \u00eencheie contractul numai dup\u0103 \u00eemplinirea unui termen de 20 de zile calendaristice de la data realiz\u0103rii comunic\u0103rii ofertan\u0163ilor despre deciziile referitoare la atribuirea contractului.<\/p>\n<p>37.2. Autoritatea contractant\u0103 are obliga\u0163ia de a informa ofertan\u0163ii despre deciziile referitoare la atribuirea contractului, \u00een scris, cu confirmare de primire, nu mai t\u00e2rziu de 3 zile lucr\u0103toare de la emiterea acestora.<\/p>\n<p>37.3. Contractul de \u00eenchiriere va fi \u00eencheiat \u00een limba rom\u00e2n\u0103, \u00een dou\u0103 exemplare, c\u00e2te unul pentru fiecare parte (anexa\u00a0 &#8211; contract cadru).<\/p>\n<p>37.4. Contractul de \u00eenchiriere se \u00eencheie \u00een form\u0103 scris\u0103, sub sanc\u0163iunea nulit\u0103\u0163ii. Contractul se \u00eencheie \u00een conformitate cu legea rom\u00e2n\u0103, indiferent de na\u0163ionalitatea sau de cet\u0103\u0163enia chiria\u015fului.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.38.<\/strong> Ne\u00eencheierea contractului atrage plata daunelor-interese de c\u0103tre partea \u00een culp\u0103. Refuzul ofertantului declarat c\u00e2\u015ftig\u0103tor de a \u00eencheia contractul de \u00eenchiriere atrage dup\u0103 sine plata daunelor-interese, care sunt egale cu valoarea garan\u0163iei depuse odat\u0103 cu oferta \u015fi pierderea dreptului de c\u00e2\u015ftig\u0103tor.<\/p>\n<p><strong>CAPITOLUL IX<\/strong><\/p>\n<p><strong>\u00a0\u00cencetarea \u00eenchirierii<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Art.39.<\/strong> La expirarea termenului de \u00eenchiriere, chiria\u015ful este obligat s\u0103 restituie, \u00een deplin\u0103 proprietate, liber de orice sarcin\u0103 terenul\/spa\u0163iul \u00eenchiriat. For\u0163a major\u0103 exonereaz\u0103 p\u0103r\u0163ile de r\u0103spundere \u00een ceea ce prive\u015fte \u00eendeplinirea total\u0103 sau par\u0163ial\u0103 a obliga\u0163iilor ce le revin, cu men\u0163iunea c\u0103 prin for\u0163\u0103 major\u0103 se \u00een\u0163elege orice eveniment independent de voin\u0163a p\u0103r\u0163ilor, imprevizibil \u015fi inevitabil care \u00eempiedic\u0103 p\u0103r\u0163ile s\u0103-\u015fi execute integral sau par\u0163ial obliga\u0163iile.<\/p>\n<p>\u00a0<\/p>\n<p><strong>Art.40.<\/strong> Apari\u0163ia sau \u00eencetarea cazului de for\u0163\u0103 major\u0103 se va comunica celeilalte p\u0103r\u0163i \u00een termen de 5 zile prin fax sau telefon urmat de o scrisoare recomandat\u0103 cu men\u0163iunea constat\u0103rii evenimentelor de acest gen de c\u0103tre organele competente rom\u00e2ne, \u00een prezen\u0163a p\u0103r\u0163ilor.<\/p>\n<p>\u00a040.1. \u00cen caz de for\u0163\u0103 major\u0103 comunicat\u0103 \u015fi constatat\u0103 \u00een condi\u0163iile de mai sus, executarea obliga\u0163iilor p\u0103r\u0163ilor se decaleaz\u0103 \u00een consecin\u0163\u0103 cu perioada corespunz\u0103toare acesteia, cu men\u0163iunea c\u0103 niciuna dintre p\u0103r\u0163i nu va pl\u0103ti penalit\u0103\u0163i sau desp\u0103gubiri pentru \u00eent\u00e2rzierea \u00een executarea contractului.<\/p>\n<p>\u00a040.2. Partea care nu a \u00eendeplinit obliga\u0163ia comunic\u0103rii va suporta irevocabil consecin\u0163ele cazului de for\u0163\u0103 major\u0103 c\u00e2t \u015fi \u00eendeplinirea tuturor celorlalte obliga\u0163ii.<\/p>\n<p>40.3. \u00cen condi\u0163iile \u00een care for\u0163a major\u0103 conduce la o decalare a obliga\u0163iilor p\u0103r\u0163ilor mai mare de 6 luni, p\u0103r\u0163ile se vor reuni pentru a hot\u0103r\u00ee asupra exercit\u0103rii \u00een viitor a clauzei incluse \u00een contract. \u00cen cazul imposibilit\u0103\u0163ii de exploatare a bunului \u00eenchiriat, situa\u0163ie verificat\u0103 \u015fi constatat\u0103 de comisia legal constituit\u0103, p\u0103r\u0163ile vor conveni asupra continu\u0103rii sau \u00eencet\u0103rii contractului.<\/p>\n<p>40.4. \u00cen cazul \u00een care autoritatea contractant\u0103 nu poate \u00eencheia contractul cu ofertantul declarat c\u00e2\u015ftig\u0103tor din cauza faptului c\u0103 ofertantul \u00een cauz\u0103 se afl\u0103 \u00eentr-o situa\u0163ie de for\u0163\u0103 major\u0103 sau \u00een imposibilitatea fortuit\u0103 de a executa contractul, autoritatea contractant\u0103 are dreptul s\u0103 declare c\u00e2\u015ftig\u0103toare oferta clasat\u0103 pe locul doi, \u00een condi\u0163iile \u00een care aceasta este admisibil\u0103.<\/p>\n<p>\u00a040.5. \u00cen cazul \u00een care, \u00een situa\u0163ia prev\u0103zut\u0103 mai sus , nu exist\u0103 o ofert\u0103 clasat\u0103 pe locul doi admisibil\u0103, procedura de licita\u021bie se anuleaz\u0103. Ulterior, autoritatea contractant\u0103 va relua procedura de licita\u0163ie.<\/p>\n<p><strong>CAPITOLUL X<\/strong><\/p>\n<p><strong>\u00a0Dispozi\u0163ii finale<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>\u00a0<strong>Art.41.<\/strong> Contractul de \u00eenchiriere se va \u00eentocmi \u015fi semna de ambele p\u0103r\u0163i, \u00een termen de 20 zile de la adjudecare dac\u0103 \u00een Caietul de sarcini nu s-a prev\u0103zut alt termen.<\/p>\n<p><strong>Art.42.<\/strong> \u00cen cazul \u00een care contractul de \u00eenchiriere nu se semneaz\u0103 \u00een termenul men\u0163ionat din vina celui care a adjudecat, licita\u0163ia se anuleaz\u0103 cu pierderea garan\u0163iei de participare la licita\u0163ie, persoana respectiv\u0103 pierz\u00e2nd dreptul de participare la o nou\u0103 licita\u0163ie av\u00e2nd acela\u015fi obiect. Garan\u0163ia de participare la licita\u0163ie se pierde \u015fi \u00een cazul denun\u0163\u0103rii unilaterale a contractului de c\u0103tre chiria\u015f, din culpa Dup\u0103 primirea \u00een folosin\u0163\u0103 a spa\u0163iului\/terenului. Locatarul nu poate formula obiec\u0163ii cu privire la starea bunului \u00eenchiriat. Predarea-primirea se va efectua dup\u0103 constituirea garan\u0163iei, conform art. 8. CAP. III &#8211; Scopul contractului <strong>Art.3.<\/strong> Spa\u0163iul\/terenul \u00eenchiriat ce face obiectul prezentului contract este dat \u00een folosin\u0163\u0103 Locatarului pentru ________________________________________________ (destina\u0163ia pentru care a fost adjudecat &#8211; conform caietului de sarcini).<\/p>\n<p><strong>Art.4<\/strong>. Destina\u0163ia bunului imobil nu poate fi schimbat\u0103 (dec\u00e2t atunci c\u00e2nd s-a urm\u0103rit procedura de schimbare a destina\u0163iei bazei materiale de c\u0103tre Locator \u015fi a fost prev\u0103zut acest lucru \u00een caietul de sarcini).<\/p>\n<p><strong>CAP. V &#8211; Pre\u0163ul contractului \u015fi modalit\u0103\u0163ile de plat\u0103 <\/strong><\/p>\n<p><strong>Art.7.<\/strong> (1) Pre\u0163ul \u00eenchirierii &#8211; chiria &#8211; este \u00een cuantum de ________ lei\/lun\u0103 cu TVA.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (2) Chiria va fi achitat\u0103 anticipat, p\u00e2n\u0103 la data de 25 a lunii \u00een curs, pentru luna urm\u0103toare, pe baza facturii emise de Locator. \u00cen situa\u0163ia \u00een care Locatorul omite s\u0103 transmit\u0103 factura pentru plata chiriei, Locatarul are obliga\u0163ia s\u0103 achite pre\u0163ul \u00eenchirierii p\u00e2n\u0103 \u00een ultima zi bancar\u0103 a lunii curente, pentru luna viitoare.<\/p>\n<p><strong>\u00a0Art.8.<\/strong> <strong>Locatarul va constitui \u015fi va men\u0163ine pe toat\u0103 perioada Contractului, \u00een contul Locatorului o garan\u0163ie \u00een cuantum de _________ lei, echivalentul chiriei datorate pentru dou\u0103 luni.<\/strong><\/p>\n<p><strong>\u00a0Art.9. Neplata chiriei \u015fi\/sau a utilit\u0103\u0163ilor pentru o perioad\u0103 de 2 luni consecutiv atrage desfiin\u0163area de plin drept a Contractului, f\u0103r\u0103 punere \u00een \u00eent\u00e2rziere, f\u0103r\u0103 alte formalit\u0103\u0163i prealabile \u015fi f\u0103r\u0103 interven\u0163ia instan\u0163elor judec\u0103tore\u015fti, precum \u015fi obliga\u0163ia chiria\u015fului la plata de daune-interese.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAP. VI &#8211; Obliga\u0163iile locatarului <\/strong><\/p>\n<p><strong>Art.13.<\/strong> Locatorul are urm\u0103toarele obliga\u0163ii :<\/p>\n<ol>\n<li>s\u0103 pl\u0103teasc\u0103 chiria \u015fi utilit\u0103\u0163ile la termenele \u015fi \u00een condi\u0163iile prev\u0103zute \u00een prezentul Contract;<\/li>\n<li>\u00een caz de neplat\u0103 a chiriei 2 luni consecutiv sau 3 luni \u00eentr-un an calendaristic \u00eendrept\u0103\u0163e\u015fte proprietarul s\u0103 rezilieze contractul din oficiu;<\/li>\n<li>s\u0103 respecte ordinea \u015fi cur\u0103\u0163enia \u00een jurul spa\u0163iului \u00eenchiriat;<\/li>\n<li>s\u0103 respecte obiectul de activitate pentru care s-a \u00eenchiriat spa\u0163iul respectiv (destina\u0163ia spa\u0163iului);<\/li>\n<li>s\u0103 nu sub\u00eenchirieze\/\u00eenstr\u0103ineze sub orice form\u0103 spa\u0163iul \u00eenchiriat;<\/li>\n<li>la expirarea termenului contractual s\u0103 predea spa\u0163iul \u00een starea \u00een care l-a primit \u015fi liber de orice sarcini. \u00cen caz contrar, lucr\u0103rile suplimentare vor fi suportate de chiria\u015f, inclusiv contravaloarea eventualelor distrugeri;<\/li>\n<li>s\u0103 suporte noile tarife \u00een cazul apari\u0163iei unor noi reglement\u0103ri privind modificarea chiriei, \u00een cadrul sau \u00een afara termenului contractual;<\/li>\n<li>s\u0103 asigure toate m\u0103surile privind prevenirea \u015fi stingerea incendiilor prev\u0103zute de legisla\u0163ia \u00een vigoare; 9. la semnarea contractului de \u00eenchiriere, s\u0103 pl\u0103teasc\u0103 contravaloarea a 2 chirii, care vor constitui garan\u0163ia, ce reprezint\u0103 contravaloarea pentru ultima perioad\u0103 a rela\u0163iei contractuale;<\/li>\n<li>s\u0103 nu aduc\u0103 modific\u0103ri constructive f\u0103r\u0103 acordul proprietarului \u015fi f\u0103r\u0103 autoriza\u0163iile prev\u0103zute de lege;<\/li>\n<\/ol>\n<p><strong>CAP. VII &#8211; \u00cencetarea contractului<\/strong><\/p>\n<p><strong>Art.14.<\/strong> Prezentul contract va \u00eenceta :<\/p>\n<ol>\n<li>la expirarea termenului pentru care a fost \u00eencheiat;<\/li>\n<li>prin acordul de voin\u0163\u0103 a p\u0103r\u0163ilor;<\/li>\n<li>prin denun\u0163are unilateral, anticipat \u015fi necondi\u0163ionat de c\u0103tre proprietar \u00een urm\u0103toarele situa\u0163ii :<\/li>\n<li>a) interesele publice o cer;<\/li>\n<li>b) schimbarea destina\u0163iei spa\u0163iului, \u00eenstr\u0103inarea, sub\u00eenchirierea, asocierea cu persoane fizice sau juridice, precum \u015fi executarea de modific\u0103ri constructive f\u0103r\u0103 acordul proprietarului \u015fi ob\u0163inerea avizelor \u015fi autoriza\u0163iilor prev\u0103zute de legisla\u0163ia \u00een vigoare;<\/li>\n<li>c) neplata chiriei 2 luni consecutiv sau 3 luni \u00eentr-un an sau nerespectarea unei alte cauze contractuale; d) neob\u0163inerea de c\u0103tre chiria\u015f a avizelor, autoriza\u0163iilor \u015fi acordurilor prev\u0103zute de lege pentru desf\u0103\u015furarea activit\u0103\u0163ii comerciale men\u0163ionate \u00een contract;<\/li>\n<li>e) spa\u0163iul a fost revendicat \u015fi redob\u00e2ndit de fostul proprietar.<\/li>\n<\/ol>\n<p>\u00a0<\/p>\n<p><strong>Art.15.<\/strong> La expirarea termenului pentru care a fost \u00eencheiat, contractul \u00eenceteaz\u0103 de drept, tacita reloca\u0163iune nu opereaz\u0103, put\u00e2nd fi prelungit numai prin acordul\u00a0 Consiliului de administratie\u00a0 al unit\u0103\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt cu o perioad\u0103 egal\u0103 cu perioada ini\u021bial\u0103,o singur\u0103 dat\u0103..<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAP.VIII &#8211; For\u0163a major\u0103 <\/strong><\/p>\n<p><strong>Art.16.<\/strong> For\u0163a major\u0103 :<\/p>\n<p>16.1 For\u0163a major\u0103 este constatat\u0103 de o autoritate competent\u0103.<\/p>\n<p>16.2 For\u0163a major\u0103 exonereaz\u0103 p\u0103r\u0163ile contractante de \u00eendeplinire a obliga\u0163iilor asumate prin prezentul contract, pe toata perioada \u00een care aceasta ac\u0163ioneaz\u0103.<\/p>\n<p>\u00a016.3 \u00cendeplinirea contractului va fi suspendat\u0103 \u00een perioada de ac\u0163iune a for\u0163ei majore, dar f\u0103r\u0103 a prejudicia drepturile ce li se cuveneau p\u0103r\u0163ilor, p\u00e2n\u0103 la apari\u0163ia acesteia.<\/p>\n<p>\u00a016.4 Partea contractant\u0103 care invoc\u0103 for\u0163a major\u0103 are obliga\u0163ia de a notifica celeilalte p\u0103r\u0163i, imediat \u015fi \u00een mod complet, producerea acesteia \u015fi s\u0103 ia orice m\u0103suri care \u00eei stau la dispozi\u0163ie, \u00een vederea limit\u0103rii consecin\u0163elor.<\/p>\n<p>16.5 Dac\u0103 for\u0163a major\u0103 ac\u0163ioneaz\u0103 sau se estimeaz\u0103 c\u0103 va ac\u0163iona o perioad\u0103 mai mare de 6 luni, fiecare parte va avea dreptul s\u0103 notifice celeilalte p\u0103r\u0163i \u00eencetarea de plin drept a prezentului contract, f\u0103r\u0103 ca vreuna dintre p\u0103r\u0163i s\u0103 poat\u0103 pretinde celeilalte p\u0103r\u0163i daune-interese.<\/p>\n<p>\u00a0<\/p>\n<p><strong>CAP. IX &#8211; Dispozi\u0163ii finale <\/strong><\/p>\n<p>Art.17. Prevederile prezentului contract sunt imperative, au putere de lege pentru p\u0103r\u0163ile contractante, conform art. 1270 din Noul cod civil.<\/p>\n<p>Art.18.
