Nova Art Metal SRL\u00a0 cu sediul in orasul Jibou str.Morii\u00a0 nr 5;<\/p>\n\n<p class=\"wp-block-paragraph\">-Referatul de aprobare nr 725\/19..01. 2021 a domnului Primar ;<\/p>\n\n<p class=\"wp-block-paragraph\">-HCL nr 61\/26.05. 2020 pentru aprobarea Regulamentului Cadru\u00a0 de vanzare a bunurilor imobile\u00a0 apartinand\u00a0 domeniului\u00a0 privat al orasului Jibou\u00a0 aflate in\u00a0 administrarea Consiliului local al orasului JIBOU;<\/p>\n\n<p class=\"wp-block-paragraph\">Avizul favorabil al\u00a0 comisiei\u00a0 de specialitate nr 1 a Consiliului local;<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0 Potrivit prevederilor art 334-346 , 311,354, 355, 363 din OUG nr. 57\/2019 privind Codul Administrativ;<\/p>\n\n<p class=\"wp-block-paragraph\">Vazand prevederile art 129 (2) lit c\u00a0 din OUG nr 57\/\u021b2019 privind Codul Administrativ;<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0 \u00cen temeiul art 196 (2) lit a)\u00a0 din OUG nr 57\/2019 privind Codul Administrativ;<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>HOT\u0102R\u0102\u0218TE:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Art.1 <\/strong>\u00a0Aprobarea\u00a0 vanzarii\u00a0 prin licitatie publica deschisa cu oferta la plic inchis pentru parcela inscrisa in CF 52683\u00a0 nr. cad 52683 in suprafata\u00a0 de 2822 mp \u2013pret minim de pornire a licitatiei 82.530 lei fara tva, echivalent 16.930 euro-conform expertizei (curs euro\u00a0 la data evaluarii 4,8742lei\/euro.)<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Art.2<\/strong> Aprobarea documentatiei\u00a0\u00a0 de atribuire\u00a0 inclusiv \u00a0caiet de sarcini\u00a0 si fisa de achizitii conform anexei\u00a0 parte integranta din prezenta .<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Art.3<\/strong> Aprobarea\u00a0 raportului de expertiza intocmit de PFA Dehelean Gheorghe prin ing. Dehelean Gheorghe- evaluator ANEVAR , conform anexei parte integranta din prezenta.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Art.4<\/strong> Desemnarea domnului consilier . sigilat.<\/strong><\/p>\n<p><strong>\u00a0Art.4<\/strong> La licita\u0163ie poate participa orice persoan\u0103 juridic\u0103 sau fizic\u0103 autorizat\u0103,rom\u00e2n\u0103 sau ofertelor.<\/p>\n<p>\u00a0<strong>Art.7<\/strong> Costul\u00a0 documentatiei \u00a0de atribuire inclusiv caiet de sarcini este <strong>de\u00a0 150 lei<\/strong> ,taxa de participare<\/p>\n<p>100 lei\u00a0 .<\/p>\n<p>\u00a0<strong>Art.8<\/strong> Anuntul licita\u0163iei aprobat de catre Conducerea Primariei Orasului Jibou va fi publicat\u00a0 intr-un cotidian de circulatie nationala, intrunul de circulatie locala , pe site-ul Primariei\u00a0\u0219i in Monitorul Oficial al Rom\u00e2niei partea a VI a.Anuntul licitatiei se trimite <strong>spre publicare cu cel putin 20 de \u00a0zile calendaristice inainte de data limita pentru depunerea ofertelor.<\/strong><\/p>\n<p>\u00a0<strong>Art.9<\/strong> Persoana interesata are dreptul de a solicia clarificari privind documentatia de atribuire.<\/p>\n<p><strong>\u00a0Art.10<\/strong> V\u00e2nz\u0103torul are obliga\u0163ia de a r\u0103spunde clar,f\u0103r\u0103 ambiguit\u0103\u0163i,la orice clarificare solicitat\u0103 \u00eentr-o perioad\u0103 care nu trebuie <strong>s\u0103 dep\u0103\u015feasc\u0103 5 zile lucr\u0103toare<\/strong> de la primirea unei astfel de solicit\u0103ri.<\/p>\n<p>\u00a0<strong>Art.11<\/strong> V\u00e2nz\u0103torul are obliga\u0163ia de a transmite r\u0103spunsurile \u00eenso\u0163ite de \u00eetreb\u0103rile aferente c\u0103tre toate persoanele interesate care au ob\u0163inut documenta\u0163ia de atribuire f\u0103r\u0103 a dezv\u0103lui identitatea celui care a solicitat clarific\u0103rile.<\/p>\n<p><strong>Art.12.<\/strong>F\u0103r\u0103 a atinge prevederile art.10 ,v\u00e2nz\u0103torul are obliga\u021bia de a transmite r\u0103spunsul la orice clarificare <strong>cu cel pu\u021bin 5 zile lucr\u0103toare \u00eenainte de data limit\u0103 pentru depunerea ofertelor.<\/strong><\/p>\n<p>In cazul \u00een care solicitarea\u00a0 de clarificare nu a fost transmis\u0103 \u00een timp util,pun\u00e2nd astfel v\u00e2nz\u0103torul \u00een imposibilitatea de a respecta termenul prev\u0103zut la art.10 ,acesta din urm\u0103 are totu\u0219i obliga\u021bia de a r\u0103spunde la solicitarea de clarificare \u00een m\u0103sura \u00een care perioada necesar\u0103 pentru elaborarea \u0219i transmiterea r\u0103spunsului face posibil\u0103 primirea acestuia de c\u0103tre persoanele interesate \u00eenainte de data limit\u0103 de depunere a ofertelor.<\/p>\n<p>DESFASURAREA LICITATIEI<\/p>\n<p><strong>ART.13<\/strong>(1)Inainte de \u00eenceperea licita\u0163iei membrii comisiei vor semna declaratii pe proprie<\/p>\n<p>r\u0103spundere privind conflictul de interese;<\/p>\n<p>(2)Pre\u015fedintele comisiei de licita\u0163ie conduce \u00eentreaga activitate dup\u0103 urm\u0103toarea procedura:<\/p>\n<p>(3) La data, ora \u015fi locul anun\u0163ate prin publica\u0163ie pentru desf\u0103\u015furarea licita\u0163iei, \u00een prezenta membrilor comisiei de licita\u0163ie, invita \u00een sala pe to\u0163i ofertan\u0163ii (personal sau mandatar \u00eemputernicit prin procura autentic\u0103 special\u0103), \u00een vederea \u00eenceperii licita\u0163iei.<\/p>\n<p>(4) Prezint\u0103 \u00een mod succint prevederile legale \u00een materie, procedura de desf\u0103\u015furare a licita\u0163iei \u015fi imobilul care face obiectul licita\u0163iei;<\/p>\n<p>(5)Se \u00eencepe licita\u0163ia parcurg\u00e2ndu-se urm\u0103toarele etape:<\/p>\n<p>(6) Se verifica integritatea plicurilor \u00een care s-au depus ofertele.<\/p>\n<p>\u00a0(7) Se verific\u0103 identitatea ofertan\u0163ilor (pe baza buletinului de identitate \u015fi a actului autentic de reprezentare).<\/p>\n<p>\u00a0(8) In cazul \u00een care plicurile sunt sigilate, fapt recunoscut de ofertan\u0163i, se trece\u00a0 la deschiderea ofertelor.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>\u00a0(9) Comisia de licita\u0163ie ,dup\u0103 deschiderea \u00een sedin\u021b\u0103 public\u0103 a primei oferte \u00eenscrise\u00a0 \u00een registrul de intrare iesire a primariei \u0219i \u00een registrul oferte ,\u00a0 verific\u0103 existen\u0163a tuturor documentelor existente \u00een plicul exterior\u00a0 ,inclusiv actelor doveditoare de plata a garan\u0163iei \u015fi a\u00a0 taxei\u00a0 documenta\u0163iei de licita\u0163ie\u00a0 si elimin\u0103 ofertele care nu con\u0163in \u00een totalitate documentele solicitate ,\u00eencheind primul proces verbal cu rezultatul analizei.<\/p>\n<p>(10) Dup\u0103 semnarea primului proces verbal de c\u0103tre to\u021bi membrii comisiei de licita\u021bie se deschid plicurile interioare,f\u0103c\u00e2ndu-se public\u0103 oferta fiec\u0103rui ofertant\u00a0 iar \u00een baza criteriilor stabilite \u00een documenta\u021bie se determin\u0103 oferta castig\u0103toare,\u00eencheindu-se al doilea\u00a0 proces verbal .<\/p>\n<p>(11)\u00a0\u00cen baza procesului-verbal care \u00eendepline\u0219te condi\u021biile prev\u0103zute la\u00a0<a href=\"https:\/\/lege5.ro\/Gratuit\/gmztqnzygy4a\/ordonanta-de-urgenta-nr-57-2019-privind-codul-administrativ?pid=289891151&amp;d=2019-07-15#p-289891151\">alin. (10)<\/a>, comisia de evaluare \u00eentocme\u0219te, \u00een termen de o zi lucr\u0103toare, un raport pe care \u00eel transmite autorit\u0103\u021bii contractante.<\/p>\n<p>(12)\u00a0\u00cen termen de 3 zile lucr\u0103toare de la primirea raportului comisiei de evaluare, autoritatea contractant\u0103 informeaz\u0103 \u00een scris, cu confirmare de primire, ofertan\u021bii ale c\u0103ror oferte au fost excluse, indic\u00e2nd motivele excluderii \u0219i ofertantul c\u00e2stig\u0103tor cu privire la acceptarea ofertei prezentate.<\/p>\n<p>13)\u00a0Raportul prev\u0103zut la\u00a0<a href=\"https:\/\/lege5.ro\/Gratuit\/gmztqnzygy4a\/ordonanta-de-urgenta-nr-57-2019-privind-codul-administrativ?pid=289891152&amp;d=2019-07-15#p-289891152\">alin. (1<\/a>2) se depune la dosarul licita\u021biei.<\/p>\n<p><strong>Comisia de evaluare <\/strong><\/p>\n<p><strong>Art.14<\/strong> (1)\u00a0La nivelul autorit\u0103\u021bii publice locale se organizeaz\u0103 o comisie de evaluare, componen\u021ba acesteia fiind aprobat\u0103 prin dispozi\u021bie a primarului, care adopt\u0103 decizii \u00een mod autonom \u0219i numai pe baza criteriilor de selec\u021bie prev\u0103zute \u00een instruc\u021biunile privind organizarea \u0219i desf\u0103\u0219urarea licita\u021biei.Evaluarea ofertelor depuse se realizeaz\u0103 de c\u0103tre\u00a0 comisia de evaluare, compus\u0103 dintr-un num\u0103r impar de membri, <strong>care nu poate fi mai mic de 5<\/strong>.<\/p>\n<p>(2)\u00a0Fiec\u0103ruia dintre membrii comisiei de evaluare i se desemneaz\u0103 un supleant.<\/p>\n<p>(3 )\u00a0Membrii comisiei de evaluare sunt:<\/p>\n<ol>\n<li>a) reprezentan\u021bi ai consiliului local , ai structurii teritoriale a Agentiei Na\u021bionale de Administrare Fiscala iar \u00een cazul \u00een care, pentru bunul care face obiectul v\u00e2nz\u0103rii este necesar\u0103 parcurgerea procedurii de reglementare din punctul de vedere al protec\u0163iei mediului, potrivit legisla\u0163iei \u00een vigoare, comisia de evaluare va include \u00een componen\u0163a sa \u015fi un reprezentant al autorit\u0103\u0163ii competente pentru protec\u0163ia mediului,<\/li>\n<li>b) inspectori din compartimentele\/serviciile de specialitate ale primarului.<\/li>\n<\/ol>\n<p>(4)\u00a0Componen\u021ba comisiei de evaluare, membrii acesteia, precum \u0219i suplean\u021bii lor se stabilesc \u0219i sunt numi\u021bi prin dispozitia primarului;<\/p>\n<p>(5)\u00a0Pre\u0219edintele comisiei de evaluare \u0219i secretarul acesteia sunt numi\u021bi de primar dintre reprezentan\u021bii acestuia \u00een comisie.<\/p>\n<p>(6)\u00a0Fiecare dintre membrii comisiei de evaluare beneficiaz\u0103 de c\u00e2te un vot.<\/p>\n<p>(7)\u00a0Deciziile comisiei de evaluare se adopt\u0103 cu votul majorit\u0103\u021bii membrilor.<\/p>\n<p>(8)\u00a0Membrii comisiei de evaluare, suplean\u021bii trebuie s\u0103 respecte regulile privind conflictul de interese , respectiv:<\/p>\n<p>(8.1)\u00a0Pe parcursul aplic\u0103rii procedurii de atribuire vanzatorul are obliga\u021bia de a lua toate m\u0103surile necesare pentru a evita situa\u021biile de natur\u0103 s\u0103 determine apari\u021bia unui conflict de interese \u0219i\/sau manifestarea concuren\u021bei neloiale.<\/p>\n<p>(8.2)\u00a0Nerespectarea prevederilor\u00a0<a href=\"https:\/\/lege5.ro\/Gratuit\/gmztqnzygy4a\/ordonanta-de-urgenta-nr-57-2019-privind-codul-administrativ?pid=289890940&amp;d=2019-07-11#p-289890940\">alin. (8.1)<\/a>\u00a0se sanc\u021bioneaz\u0103 potrivit dispozi\u021biilor legale \u00een vigoare.<\/p>\n<p>(8.3)\u00a0Persoana care a participat la \u00eentocmirea documenta\u021biei de atribuire are dreptul de a fi ofertant, dar numai \u00een cazul \u00een care implicarea sa \u00een elaborarea documenta\u021biei de atribuire nu este de natur\u0103 s\u0103 defavorizeze concuren\u021ba.<\/p>\n<p>(8.4)\u00a0Persoanele care sunt implicate direct \u00een procesul de verificare\/evaluare a ofertelor nu au dreptul de a fi ofertant sub sanc\u021biunea excluderii din procedura de atribuire.<\/p>\n<p><strong>(8.5)<\/strong>\u00a0Nu au dreptul s\u0103 fie implicate \u00een procesul de verificare\/evaluare a ofertelor urm\u0103toarele persoane:<\/p>\n<ol>\n<li>a)so\u021b\/so\u021bie, rud\u0103 sau afin p\u00e2n\u0103 la gradul al II-lea inclusiv cu ofertantul, persoan\u0103 fizic\u0103;<\/li>\n<li>b)so\u021b\/so\u021bie, rud\u0103 sau afin p\u00e2n\u0103 la gradul al II-lea inclusiv cu persoane care fac parte din consiliul de administra\u021bie, organul de conducere ori de supervizare al unuia dintre ofertan\u021bi, persoane juridice, ter\u021bi sus\u021bin\u0103tori sau subcontractan\u021bi propu\u0219i;<\/li>\n<li>c)persoane care de\u021bin p\u0103r\u021bi sociale, p\u0103r\u021bi de interes, ac\u021biuni din capitalul subscris al unuia dintre ofertan\u021bi, ter\u021bi sus\u021bin\u0103tori sau subcontractan\u021bi propu\u0219i sau persoane care fac parte din consiliul de administra\u021bie, organul de conducere ori de supervizare al unuia dintre ofertan\u021bi, ter\u021bi sus\u021bin\u0103tori sau subcontractan\u021bi propu\u0219i;<\/li>\n<li>d)membri \u00een cadrul consiliului de administra\u021bie\/organului de conducere sau de supervizare al ofertantului \u0219i\/sau ac\u021bionari ori asocia\u021bi semnificativi persoane care sunt so\u021b\/so\u021bie, rud\u0103 sau afin p\u00e2n\u0103 la gradul al II-lea inclusiv ori care se afl\u0103 \u00een rela\u021bii comerciale cu persoane cu func\u021bii de decizie \u00een cadrul entit\u0103\u021bii contractante.<\/li>\n<\/ol>\n<p>(8.6)\u00a0Nu pot fi nominalizate de c\u0103tre ofertant pentru executarea contractului persoane care sunt so\u021b\/so\u021bie, rud\u0103 sau afin p\u00e2n\u0103 la gradul al II-lea inclusiv ori care se afl\u0103 \u00een rela\u021bii comerciale cu persoane cu func\u021bii de decizie \u00een cadrul entit\u0103\u021bii contractante.<\/p>\n<p>(9)\u00a0Membrii comisiei de evaluare, suplean\u021bii sunt obliga\u021bi s\u0103 dea o declara\u021bie de compatibilitate, impar\u021bialitate \u0219i confiden\u021bialitate pe propria r\u0103spundere, dup\u0103 termenul-limit\u0103 de depunere a ofertelor, care se va p\u0103stra al\u0103turi de dosarul licitatiei.<\/p>\n<p>(10)\u00a0\u00cen caz de incompatibilitate, pre\u0219edintele comisiei de evaluare sesizeaz\u0103 de \u00eendat\u0103 autoritatea publica locala despre existen\u021ba st\u0103rii de incompatibilitate \u0219i va propune \u00eenlocuirea persoanei incompatibile, dintre membrii suplean\u021bi.<\/p>\n<p>(11)\u00a0Suplean\u021bii particip\u0103 la \u0219edin\u021bele comisiei de evaluare numai \u00een situa\u021bia \u00een care membrii acesteia se afl\u0103 \u00een imposibilitate de participare datorit\u0103 unui caz de incompatibilitate, caz fortuit sau for\u021bei majore.<\/p>\n<p>(12)\u00a0Atribu\u021biile comisiei de evaluare sunt:<\/p>\n<ol>\n<li>a)analizarea \u0219i selectarea ofertelor pe baza datelor, informa\u021biilor \u0219i documentelor cuprinse \u00een plicul exterior;<\/li>\n<li>b)\u00eentocmirea listei cuprinz\u00e2nd ofertele admise \u0219i comunicarea acesteia;<\/li>\n<li>c)analizarea \u0219i evaluarea ofertelor;<\/li>\n<li>d)\u00eentocmirea raportului de evaluare;<\/li>\n<li>e)\u00eentocmirea proceselor-verbale;<\/li>\n<li>f)desemnarea ofertei c\u00e2\u0219tig\u0103toare.<\/li>\n<\/ol>\n<p>(13)\u00a0Comisia de evaluare este legal \u00eentrunit\u0103 numai \u00een prezen\u021ba tuturor membrilor.<\/p>\n<p>(14)\u00a0Comisia de evaluare adopt\u0103 decizii \u00een mod autonom, numai pe baza documenta\u021biei de atribuire \u0219i \u00een conformitate cu prevederile legale \u00een vigoare.<\/p>\n<p>(15)\u00a0Membrii comisiei de evaluare au obliga\u021bia de a p\u0103stra confiden\u021bialitatea datelor, informa\u021biilor \u0219i documentelor cuprinse \u00een ofertele analizate.<\/p>\n<p><strong>(16 ) Comisia de evaluare a ofertelor a fost stabilita prin HCL nr&#8230;&#8230;&#8230;. din&#8230;&#8230;&#8230;&#8230;&#8230;..2021 si Dispozitia Primarului nr&#8230;&#8230;.din&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;2021.<\/strong><\/p>\n<p>\u00a0(17)Oferta<\/p>\n<ol>\n<li>a) ofertantul are obliga\u0163ia de a elabora oferta \u00een conformitate cu prevederile prezentei documenta\u0163ii;<\/li>\n<li>b) oferta are caracter obligatoriu din punct de vedere al continutului pe toata perioada de valabilitate stabilita de vanzator. <strong>Perioada de utilit\u0103tile permise enumerate mai sus.<\/p>\n<p><strong>Art.18.<\/strong>MOTIVATIA VANZARII\u00a0\u00a0\u00a0 -Motive de ordin legislativ,economic financiar,social\u00a0 si de mediu urm\u0103rite de c\u0103tre v\u00e2nz\u0103tor\u00a0 care impun vanzarea imobilului sunt urmatoarele :<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (1)Dispozi\u021biile Art.354\u00a0 (1) si (2) din O.U.G nr.57\/2019 privind Codul administrativ\u00a0 ce precizeaza<\/p>\n<p>,, domeniul privat al statului sau\u00a0 al unit\u0103tilor administativ teritoriale este alc\u0103tuit din bunuri aflate \u00een evaluare\u201d.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 (4) prevederile art. 553 (1) si (4)din Legea LEGE\u00a0\u00a0 Nr. 287\/2009 din 17 iulie 2009 republicat\u0103 privind Codul civil- proprietatea\u00a0 privat\u0103\u00a0\u00a0\u00a0<\/p>\n<p>\u00a0\u00a0\u00a0 \u00a0-(1) Sunt obiect al propriet\u0103\u0163ii private toate bunurile de uz sau de interes privat apar\u0163in\u00e2nd persoanelor fizice, persoanelor juridice de drept privat sau de drept public, <strong>inclusiv bunurile care alc\u0103tuiesc domeniul privat al statului \u015fi al unit\u0103\u0163ilor administrativ-teritoriale<\/strong>.<\/p>\n<p>\u00a0\u00a0 &#8211; \u00a0(4) Bunurile obiect al propriet\u0103\u0163ii private, indiferent de titular, sunt \u015fi r\u0103m\u00e2n \u00een circuitul civil, dac\u0103 prin lege nu se dispune altfel. anex\u0103 \u00a0la caietul de sarcini ;<\/p>\n<p><strong>Algoritm de calcul pentru criteriul\u00a0 prev\u0103zut la litera d \u2013valoarea planificat\u0103 \u00a0a investitiei):<\/strong><\/p>\n<p><strong><em>\u00a0Punctajul de la criteriul ( 1 )litera\u00a0 d ) se acorda astfel:<\/em><\/strong><\/p>\n<p>-cel mai mare nivel a valoarei planificat\u0103 a investi\u021biei\u00a0 <strong>se puncteaz\u0103\u00a0 cu 15 puncte<\/strong>\u00a0 iar termenul de execu\u021bie cel mai scurt <strong>se puncteaz\u0103 cu 10 puncte<\/strong> ;<\/p>\n<p>-pentru celelalte\u00a0 oferte\u00a0 <strong>punctajul P(n<\/strong>) se calculeaza proportional, astfel:<\/p>\n<p><strong>P(n)<\/strong> = ( Suma valoare planificat\u0103 oferta analizat\u0103\/\u00a0 Cea mai mare valoare planificat\u0103 a invisti\u021biei x punctaj maxim alocat.<\/p>\n<p><strong>P(n)=<\/strong> ( cel mai scurt termen de executie \/ termenul de executie din oferta analizat\u0103) X punctaj maxim alocat.<\/p>\n<p>\u00a0<\/p>\n<p><strong>e)<\/strong>angajamente referitoare la personalul angajat asumate de investitor\/cump\u0103r\u0103tor<\/p>\n<p>\u00a0<strong>Formular nr.IV<\/strong> \u2013 anex\u0103\u00a0 la caietul de sarcini\u00a0 <strong>(<\/strong><strong> se puncteaza cu 15 \u00a0puncte<\/strong>)<\/p>\n<p><strong><em>Punctajul de la criteriul \u00a0(1) litera\u00a0 e ) se acorda astfel:<\/em><\/strong><\/p>\n<p><strong><em>cel mai mare nr.de personal angajat asumat de investitor se puncteaz\u0103 cu 15 puncte<\/em><\/strong><\/p>\n<p><strong>P(n)=<\/strong>Nr .de angaja\u021bi oferta analizat\u0103\/cel mai mare nr.de personal angajat\u00a0 x punctaj maxim alocat<\/p>\n<p>\u00a0<\/p>\n<p><strong>\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Clarificari \u0219i situa\u021bii de eliminare<\/strong><\/p>\n<p>Art.25 \u00a0Pe parcursul aplic\u0103rii procedurii de atribuire<strong>, v\u00e2nzatorul<\/strong> are dreptul de a solicita clarific\u0103ri \u0219i, dup\u0103 caz, complet\u0103ri ale documentelor prezentate de ofertan\u021bi pentru demonstrarea conformit\u0103\u021bii ofertei cu cerin\u021bele solicitate.<\/p>\n<p>Art.26 Solicitarea de clarific\u0103ri este propus\u0103 de c\u0103tre comisia de evaluare \u0219i se transmite de c\u0103tre vanzator ofertan\u021bilor \u00een termen de 3 zile lucr\u0103toare de la primirea propunerii comisiei de evaluare.<\/p>\n<p>Art.27 \u00a0Ofertan\u021bii trebuie s\u0103 r\u0103spund\u0103 la solicitarea vanzatorului \u00een termen de 3 zile lucr\u0103toare de la primirea acesteia.<\/p>\n<p>Art.28 \u00a0Vanzatorul nu are dreptul ca, prin clarific\u0103rile ori complet\u0103rile solicitate, s\u0103 determine apari\u021bia unui avantaj \u00een favoarea unui ofertant.<\/p>\n<p>Art.29 \u00a0Plicurile sigilate se predau comisiei de evaluare \u00een ziua fixat\u0103 pentru deschiderea lor, prev\u0103zut\u0103 \u00een anun\u021bul de licita\u021bie.<\/p>\n<p><strong>Art.30<\/strong><strong>\u00a0Dup\u0103 deschiderea plicurilor exterioare \u00een \u0219edin\u021b\u0103 public\u0103, comisia de evaluare elimin\u0103 ofertele care nu respect\u0103 urmatoarele:<\/strong><\/p>\n<p>&#8211;\u00a0Ofertele se redacteaz\u0103 \u00een limba rom\u00e2n\u0103.<\/p>\n<p>&#8211;\u00a0Ofertele se depun la sediul autorit\u0103\u021bii contractante sau la locul precizat \u00een anun\u021bul de licita\u021bie, \u00een dou\u0103 plicuri sigilate, unul exterior \u0219i unul interior, care se \u00eenregistreaz\u0103 de autoritatea contractant\u0103, \u00een ordinea primirii lor, \u00een registrul Oferte, preciz\u00e2ndu-se data \u0219i ora.<\/p>\n<p><strong>&#8211;<\/strong><strong>\u00a0Pe plicul exterior se va indica obiectul licita\u021biei pentru care este depus\u0103 oferta. Plicul exterior va trebui s\u0103 con\u021bin\u0103:<\/strong><\/p>\n<ol>\n<li>a)o fi\u0219\u0103 cu informa\u021bii privind ofertantul \/ declara\u021bi de participare, semnat\u0103 de ofertant, f\u0103r\u0103 \u00eengro\u0219\u0103ri, \u0219ters\u0103turi sau modific\u0103ri;<\/li>\n<li>b)acte doveditoare privind calit\u0103\u021bile \u0219i capacit\u0103\u021bile ofertan\u021bilor, conform solicit\u0103rilor autorit\u0103\u021bii contractante;<\/li>\n<li>c)acte doveditoare privind intrarea \u00een posesia caietului de sarcini.<\/li>\n<\/ol>\n<p><strong>&#8211;\u00a0Pe plicul interior,<\/strong> care con\u021bine oferta propriu-zis\u0103, se \u00eenscriu numele sau denumirea ofertantului, precum \u0219i domiciliul sau sediul social al acestuia, dup\u0103 caz.<\/p>\n<p>ART.31 \u00a0Pentru continuarea desf\u0103\u0219ur\u0103rii procedurii de licita\u021bie este necesar ca, dup\u0103 deschiderea plicurilor exterioare, cel pu\u021bin dou\u0103 oferte s\u0103 \u00eentruneasc\u0103 condi\u021biile prev\u0103zute mai sus.<\/p>\n<p><em>\u00a0ART.32 \u00cen cazul \u00een care \u00een urma public\u0103rii anun\u021bului de licita\u021bie nu au fost depuse cel pu\u021bin dou\u0103 oferte valabile, autoritatea public\u0103 local\u0103 este obligat\u0103 s\u0103 anuleze procedura \u0219i s\u0103 organizeze o nou\u0103 licita\u021bie, cu respectarea procedurii initiale.<\/em><em>Pentru cea de-a doua licita\u021bie va fi p\u0103strat\u0103 documenta\u021bia de atribuire aprobat\u0103 pentru prima licita\u021bie. <\/em><\/p>\n<p><em>In situatia \u00een care ,la cea de a doua procedur\u0103 de licitatie s-a depus o singur\u0103 ofert\u0103\u00a0 \u0219i aceasta este valabil\u0103 sau au fost depuse mai multe oferte dintre care una singur\u0103 este valabila,autoritatea contractant\u0103\u00a0 va atribui contractul celui\/celei care a depus respectiva ofert\u0103 valabil\u0103.<\/em><\/p>\n<p><em>Pentru licitatia a doua, dup\u0103 publicitatea anuntat\u0103 din nou , comisia de licitatie se \u00eentruneste la data anuntat\u0103 \u0219i analizeaz\u0103 con\u021binutul ofertelor astfel:<\/em><\/p>\n<p>\u00a0(1)\u00a0Se\u00a0 analizeaz\u0103 con\u021binutului <strong>plicului exterior<\/strong>,iar \u00a0secretarul comisiei de evaluare \u00eentocme\u0219te un proces-verbal \u00een care se va preciza rezultatul analizei<strong>. ( I) <\/strong>potrivit art.336 alin (2)- (5)OUG 57\/2019\u00a0 Cod administrativ<\/p>\n<p>(2)\u00a0Deschiderea <strong>plicurilor interioare<\/strong> se face numai dup\u0103 semnarea procesului-verbal al licitatiei prev\u0103zut la\u00a0 Art.32 pct.(1) \u00a0de c\u0103tre to\u021bi membrii comisiei de evaluare \u0219i de c\u0103tre ofertan\u021bi.<\/p>\n<p>(3)\u00a0Sunt considerate oferte valabile ofertele care \u00eendeplinesc criteriile de valabilitate prev\u0103zute \u00een caietul de sarcini.<\/p>\n<p>(4)\u00a0\u00cen urma analiz\u0103rii ofertelor de c\u0103tre comisia de evaluare, pe baza criteriilor de valabilitate, secretarul acesteia \u00eentocme\u0219te un proces-verbal \u00a0<strong>(II )<\/strong>\u00een care men\u021bioneaz\u0103 ofertele valabile, ofertele care nu \u00eendeplinesc criteriile de valabilitate \u0219i motivele excluderii acestora din urm\u0103 de la procedura de licita\u021bie. Procesul-verbal se semneaz\u0103 de c\u0103tre to\u021bi membrii comisiei de evaluare.<\/p>\n<p>5)Oferta c\u00e2\u0219tig\u0103toare este oferta care \u00eentrune\u0219te cel mai mare punctaj \u00een urma aplic\u0103rii criteriilor de atribuire.<\/p>\n<p>(6)\u00a0\u00cen baza procesului-verbal care \u00eendepline\u0219te condi\u021biile prev\u0103zute la art.32\u00a0<a href=\"https:\/\/lege5.ro\/Gratuit\/gmztqnzygy4a\/ordonanta-de-urgenta-nr-57-2019-privind-codul-administrativ?pid=289891151&amp;d=2019-07-15#p-289891151\">alin. ()<\/a>, comisia de evaluare \u00eentocme\u0219te, \u00een termen de o zi lucr\u0103toare, un<strong> raport<\/strong> pe care \u00eel transmite autorit\u0103\u021bii contractante.<\/p>\n<p>(7)\u00a0\u00cen termen de 3 zile lucr\u0103toare de la primirea raportului comisiei de evaluare, autoritatea contractant\u0103 informeaz\u0103 \u00een scris, cu confirmare de primire, ofertan\u021bii ale c\u0103ror oferte au fost excluse, indic\u00e2nd motivele excluderii precum si pe cei ai c\u0103ror oferte au fost acceptate.<\/p>\n<p>(8)\u00a0Raportul prev\u0103zut la\u00a0<a href=\"https:\/\/lege5.ro\/Gratuit\/gmztqnzygy4a\/ordonanta-de-urgenta-nr-57-2019-privind-codul-administrativ?pid=289891152&amp;d=2019-07-15#p-289891152\">alin. (13<\/a>) se depune la dosarul licita\u021biei.<\/p>\n<p>(9)\u00a0Comisia de evaluare stabile\u0219te punctajul fiec\u0103rei oferte, \u021bin\u00e2nd seama de urmatoarele:<\/p>\n<p>&#8211; Ponderea fiec\u0103rui criteriu stabilit \u00een documenta\u021bia de atribuire este\u00a0 propor\u021bional cu importan\u021ba acestuia apreciat din punctul de vedere al asigur\u0103rii unei utiliz\u0103ri\/exploat\u0103ri ra\u021bionale \u0219i eficiente economic a bunului v\u00e2ndut. Ponderea fiec\u0103ruia dintre criteriile prev\u0103zute \u00een documenta\u021bie \u00a0este de p\u00e2n\u0103 la 40%, iar suma acestora nu\u00a0 dep\u0103\u0219este 100%.<\/p>\n<p>-Ponderea fiecarui criteriu in partea fost\u00a0 \u00a0stabilit\u0103 prin documenta\u021bia de atribuire \u00a0in functie de importanta si conditiile de exploatare ale terenului in cauza.<\/p>\n<p>.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0 <strong>Dispozi\u021bii finale<\/strong><\/p>\n<p>Art.33. Pentru rezolvarea aspectelor sau situatiilor neprevazute care ar putea sa apara cu ocazia desfasurarii licitatiei, comisia de evaluare \u00a0poate lua decizii in limitele competentelor stabilite si in conformitate cu reglementarile legale in vigoare, decizii care vor fi consemnate in procesul verbal al licitatiei si notificate in mod corespunzator participantilor la licitatie.<\/p>\n<p>Art.34\u00a0\u00cen cazul \u00een care exist\u0103 punctaje egale \u00eentre ofertan\u021bii clasa\u021bi pe primul loc, departajarea acestora se va face \u00een func\u021bie de punctajul ob\u021binut pentru criteriul de atribuire care are ponderea cea mai mare, iar \u00een cazul egalit\u0103\u021bii \u00een continuare, departajarea se va face \u00een func\u021bie de punctajul ob\u021binut pentru criteriul de atribuire care are ponderea cea mai mare dup\u0103 acesta. \u00cen cazul \u00een care exist\u0103 punctaje egale \u00eentre ofertan\u021bii clasa\u021bi pe primul loc,dup\u0103 primele etape de departajare prevazute anterior departajarea acestora se va face prin licitatie cu strigare pornind de la pretul ofertat. Pasul licita\u021biei este de\u00a0 5 % din pre\u021bul ofertat.<\/p>\n<p>\u00a0Art.35In cazul \u00een care ,\u00een cadrul celei de-a doua proceduri de licita\u021bie public\u0103 nu se depune nicio ofert\u0103 valabil\u0103,autoritatea contractant\u0103 anuleaz\u0103 procedura de licita\u021bie.<\/p>\n<p>Art.36 \u00a0Vanzatorul are obliga\u021bia de a \u00eencheia contractul de vanzare-cumpare in forma autentica la notariat cu ofertantul a c\u0103rui ofert\u0103 a fost stabilit\u0103 ca fiind c\u00e2\u0219tig\u0103toare.<\/p>\n<p>Art.37 Vanzatorul are obliga\u021bia de a transmite spre publicare \u00een Monitorul Oficial al Rom\u00e2niei, Partea a VI-a, un anun\u021b de atribuire a contractului, <strong>\u00een cel mult 20 de zile calendaristice de la finalizarea procedurii de atribuire.<\/strong><\/p>\n<p>Art.38 \u00a0Anun\u021bul de atribuire trebuie s\u0103 cuprind\u0103 cel pu\u021bin urm\u0103toarele elemente:<\/p>\n<ol>\n<li>a)informa\u021bii generale privind vanzatorul, precum: denumirea, codul de identificare fiscal\u0103, adresa, datele de contact, persoana de contact;<\/li>\n<li>b)data public\u0103rii anun\u021bului de licita\u021bie \u00een Monitorul Oficial al Rom\u00e2niei, Partea a VI-a;<\/li>\n<li>c)criteriile utilizate pentru determinarea ofertei c\u00e2\u0219tig\u0103toare;<\/li>\n<li>d)num\u0103rul ofertelor primite \u0219i al celor declarate valabile;<\/li>\n<li>e)denumirea\/numele \u0219i sediul\/adresa ofertantului a c\u0103rui ofert\u0103 a fost declarat\u0103 c\u00e2\u0219tig\u0103toare;<\/li>\n<li>f)instan\u021ba competent\u0103 \u00een solu\u021bionarea litigiilor ap\u0103rute \u0219i termenele pentru sesizarea instan\u021bei;<\/li>\n<li>g)data inform\u0103rii ofertan\u021bilor despre decizia de stabilire a ofertei c\u00e2\u0219tig\u0103toare;<\/li>\n<li>h)data transmiterii anun\u021bului de atribuire c\u0103tre institu\u021biile abilitate, \u00een vederea public\u0103rii.<\/li>\n<\/ol>\n<p>Art.39\u00a0Vanzatorul are obliga\u021bia de a informa ofertan\u021bii despre deciziile referitoare la atribuirea contractului, \u00een scris, cu confirmare de primire, nu mai t\u00e2rziu de 3 zile lucr\u0103toare de la emiterea acestora.<\/p>\n<p>Art.40\u00a0\u00cen cadrul comunic\u0103rii prev\u0103zute la art.39\u00a0vanzatorul are obliga\u021bia de a informa ofertantul\/ofertan\u021bii c\u00e2\u0219tig\u0103tor\/c\u00e2\u0219tig\u0103tori cu privire la acceptarea ofertei\/ofertelor prezentate.<\/p>\n<p>Art.41 \u00a0\u00cen cadrul comunic\u0103rii prev\u0103zute la art.39 \u00a0vanzatorul are obliga\u021bia de a informa ofertan\u021bii care au fost respin\u0219i sau a c\u0103ror ofert\u0103 nu a fost declarat\u0103 c\u00e2\u0219tig\u0103toare asupra motivelor ce au stat la baza deciziei respective.<\/p>\n<p>Art.42)\u00a0Autoritatea contractant\u0103 poate s\u0103 \u00eencheie contractul numai dup\u0103<strong> \u00eemplinirea unui termen de 20 de zile calendaristice de la data realiz\u0103rii comunic\u0103rii prev\u0103zute la\u00a0<\/strong>art.39.<\/p>\n<p>\u00a0Art.43 Dup\u0103 v\u00e2nzarea imobilului se va face proiect legal avizat si aprobat , se va\u00a0 ob\u0163ine Autoriza\u0163ie de Construc\u0163ii emisa de organele competente in conformitate cu:<\/p>\n<p>&#8211; prevederile Legii nr.50\/1991, republicata ,<\/p>\n<p>&#8211; Regulamentul local\u00a0 de urbanism\u00a0<\/p>\n<p><strong>SECTIUNEA VI -Instruc\u0163iuni privind modul de utilizare a c\u0103ilor de atac.<\/strong><\/p>\n<p>\u00a0<strong>Art. 44<\/strong> Litigiile de orice fel ,care decurg din executarea prezentului contract se vor solutiona pe cale amiabila. Eventualele contestatii cu privire la desfasurarea licitatiei publice se vor depune la registratura Primariei in termen de 48 de ore de la data desfasurarii licitatiei iar comisia de solutionare a contestatiilor va analiza si instrumenta contestatiile inregistrate in termen de 5 zile de la data inregistrarii acestora.In cazul\u00a0 in care contestatarul nu este multumit\u00a0 de raspunsul primit ,solutionarea litigiului este de competenta instantei judecatoresti.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Sectiunea VII Contractul \u2013Clauze contractuale.<\/strong><\/p>\n<p><strong>Art. 45<\/strong> \u00a0(1) \u00a0In \u00a0baza proceselor verbale de\u00a0 licitatie,a raportului intocmit de comisia de licita\u021bie \u015fi a Hot\u0103r\u00e2rii Consiliului Local privind aprobarea v\u00e2nz\u0103rii, se va \u00eencheia actul de v\u00e2nzare cump\u0103rare la un Birou Notarial \u00een termen de 20 zile de la data comunic\u0103rii ofertantului catigator rezultatele licitatiei.<\/p>\n<p>(2) Pan\u0103 la data \u00eencheierii contractului de v\u00e2nzare cump\u0103rare, cump\u0103r\u0103torul are obliga\u0163ia de a achita integral valoarea adjudecat\u0103.<\/p>\n<p>(3)Cump\u0103r\u0103torul are dreptul de a realiza lucr\u0103ri de interes public la limita amplasamentului cu condi\u0163ia notific\u0103rii inten\u0163iei c\u0103tre v\u00e2nz\u0103tor \u0219i a intocmirii documentatiei de autorizare,<\/p>\n<p>(4) Cumparatorul are intreaga responsabilitate in ceea ce priveste respectarea legislatiei in vigoare cu privire la PSI ,Protectia mediului si persoanelor<\/p>\n<p>(5)Toate cheltuielile aferente v\u00e2nz\u0103rii vor fi suportate de cump\u0103r\u0103tor.\u00a0 Cumparatorul are obligatia sa plateasca cheltuielile vanzarii : cheltuieli propriu zise ale actului,taxele de timbru si autentificare \u2013 onorariul notarial,<\/p>\n<p>(6).Nesemnarea de catre adjudecator a contractului in termenul stabilit duce la pierderea garantiei de participare si disponibilizarea activului pentru o noua licitatie.<\/p>\n<p>(7) Vanzatorul garanteaza pe cumparator ca bunul vandut nu este sechestrat,scos din circuitul civil,ipotecat sau gajat.<\/p>\n<p>(8)\u00a0 Vanzatorul nu raspunde de viciile aparente ,<\/p>\n<p>\u00a0(9) Toate obligatiile reciproce se vor concretiza in contractul de vanzare cumparare.<\/p>\n<p>(10) Transmiterea dreptului de proprietate opereaza in momentul incheierii contractului de vanzare cumparare in forma autentica.<\/p>\n<p>(11)Imobilul\u00a0 va fi predat \u00een starea in care se g\u0103se\u015fte, f\u0103r\u0103 alte obliga\u0163ii din\u00a0 partea autoritatilor locale.\u00a0\u00a0<\/p>\n<p>(12) Hotararea Consiliului local de aprobare a v\u00e2nz\u0103rii \u0219i Caietul de sarcini \u00a0cu\u00a0 \u00eentreaga documenta\u021bie aferent\u0103 vor \u00a0fi parte integranta din contract.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 FORMULAR DE OFERTA\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>FORMULAR\u00a0 NR. Aceste \u00eemprejurari pot oric\u00e2nd genera costuri suplimentare pentru investitii, iar suportarea lor revine \u00een sarcina cumparatorului.<\/p>\n<p>-declar c\u0103 amplasarea construc\u021biilor \u0219i functionarea unitatilor economice se va face cu aplicarea tuturor normativelor \u00een vigoare privind protectia factorilor de mediu \u0219i nu se vor desfasura \u00een zona activitati economice susceptibile de poluare a \u00a0aerului, apei si solului.<\/p>\n<p>-Toate activitatile se vor desfasura \u00een incinte \u00eenchise, nici una din ele nu va dezvolta zgomote si vibra\u021bii sesizabile din exterior la limita incintei.<\/p>\n<p>&#8211;\u00a0 Voi respecta prevederile Regulamentelor nationale referitoare la zgomotul produs de fabrici precum si Regulamentele UE referitoare la protectia muncitorilor de zgomot. Depozitarea externa se va face \u00een containere sau rezervoare care vor fi ascunse vederii si la distanta de drumul de acces. Containerele de gunoi si de rebuturi vor fi de asemenea ascunse vederii. Acestea vor fi ascunse cu ajutorul zidurilor, terasamentelor, gardurilor, precum si a copacilor si plantelor. Dac\u0103 este necesar accesul pentru \u00eencarcare\/descarcare si livrare, aceste depozite vor fi localizate \u00een spatele cladirilor si vor fi ascunse vederii prin aranjamente adecvate.<\/p>\n<p>&#8211; voi \u00a0prevedea de asemenea spatii suficiente pentru \u00eencarcare\/descarcare \u00een interiorul locatiei iar toate deseurile si produsele reziduale vor fi colectate si depozitate \u00eentr-o arie special amenajata \u00een acest scop. Deseurile\u00a0 vor fie colectate pentru reciclare sau re-utilizare, daca este posibil\u00a0 iar deseurile care nu pot fi re-utilizate vor fi depozitate la o groapa de gunoi aprobata de autoritatile, respect\u00e2nd Regulile Uniunii Europene referitoare la deseuri \u0219i \u00eencheind contract cu firma specializat\u0103 \u00een colectarea de\u0219eurilor;<\/p>\n<p>-Toate deseurile chimice si toxice vor fi eliminate conform Regulilor UE referitoare la deseurile toxice si periculoase.<\/p>\n<p>-Se vor pastra documente prin care se \u00eenregistreaza tipul, cantitatea, data si modul \u00een care s-au eliminat deseurile.<\/p>\n<p>-Se vor elimina deseurile respect\u00e2nd cerintele autoritatilor sanitare\u0219i se vor lua m\u0103surile care se impun\u00a0 \u00een a\u0219a fel (2)<\/a>, vanzatorul are obliga\u021bia de a transmite r\u0103spunsul la orice clarificare cu cel pu\u021bin 5 zile lucr\u0103toare \u00eenainte de data-limit\u0103 pentru depunerea ofertelor.<\/p>\n<p>(5)\u00a0\u00cen cazul \u00een care solicitarea de clarificare nu a fost transmis\u0103 \u00een timp util, pun\u00e2nd astfel vanzatorul \u00een imposibilitatea de a respecta termenul prev\u0103zut la\u00a0<a href=\"https:\/\/lege5.ro\/Gratuit\/gmztqnzygy4a\/ordonanta-de-urgenta-nr-57-2019-privind-codul-administrativ?pid=289891094&amp;d=2019-07-11#p-289891094\">alin.
